On 10/13/03 we went to Cottman Transmission and ask to check out the transmission on our 1986 Winnebago Elandan 31-ft. R.V. Mike said they found metal pieces in the pan and on the filter and said it needed a new torque converter and the transmission needed to be rebuilt.

He quoted us a price of 1,703.44 with a 24-month or 24,000 mile warranty. We trusted his judgment and professional ability to repair the trans.

On 10-22-2003 we paid for the work and went to the Koa campground in St.Pete about 6 miles away. We left Florida on our way back home to Chicago, IL. We got to Nashville, Ten. And the trans blew up. It broke the trans case and the Flywheel and all the internal parts. We had it towed to the Cottman in Nashville Ten on 10/31/2003.

Two weeks later they called and said it was done. On 11-10-2003 I took a plane back to Nashville and picked up the R.V. and started home again.

All was well until I got about 5 miles from home and the trans blew up again. I called the Cottman in Mchenry, IL. They said they didn't have room to do the work the R.V. because it was too big. Called costumer service and they said to tow it to a repair shop that could get it in. So we had it towed to Botts Truck Repair and told them about it and they said they would talk to Cottman and do the warranty work with Cottman.

Now our R.V. is still at the repair shop and has been for two months and no work has been done. Customer service said they don't have anything to do with the warranty and the Cottman in Nashville says they will not warranty the work. They refunded the money back to Cottman in Fl. now the Cottman in Fl. says they wont give us our money back and they cant find anyone to take the trans out for $300.00. That's all they want to pay.

We asked for our money back and they don't want to do that either.

We went to Small Claims Court and filed. We go to Court on Jan.22, 2004.

We want this to get on the report so it doesn't happen to other people.

This is the amount we had to pay.

Rebuilt trans. $1,703.44

Towing in Ten. $205.00

Air fair and taxi. $150.00 + $90.00 = $240.00

Towing in IL. $158.00

Repair Shop BOTTS. $144.00

Total out of pocket Amount. $2,450.44

On 11-11-2003 Called Mchenry Cottman and they said the R.V. is too big and call customer service to find out where to take it and Carol said to have it towed to a R.V. repair place and it got towed to Botts in Woodstock, IL.

On 11-12-2003 at 4:51pm talked to Carol at customer service.

On 11-12-2003 at 6:05pm Talked to Pat at Cottman in Mchenry and she said they would do the warranty work if an Independent mechanic can take out the transmission because the R.V. wont fit in there shop.

On 11-13-2003 at 5:35pm Talked to Donna at Cottman customer service and she said that Carol knows more about it.

On 11-14-2003 at 9:22am talked to Lisa at customer service.

On 11-14-2003 at 2:53pm talked to Pat at Mchenry Cottman and said she has been in touch with the Operations manager and will get back to me and never did.

On 11-17-2003 at 11:30am talked to Pat at Mchenry Cottman and she said she's waiting for Mike in St.Pete Cottman to call and to pay for the work that needs to be done.

On 11-25-2003 Called Lisa at customer service and she said they are no longer involved and it's up to the Independent Cottman to take care of this.

On 12-2-2003 talked to Mark at St.Pete Cottman and Donna with Customer service, still unresolved.

On 12-6-2003 talked to Mike at St.Pete Cottman and he said it's all up to the Nashville Cottman to resolve this. Then I talked to Ken at Nashville Cottman and he said he refunded the money back to Mike at St.Pete Cottman. I called Mike back and he said to call Jeff Walte (operations manager) left massage got no return call.

On 12-15-2003 Talked to Mike St.Pete and he said he got the money back from Nashville Cottman. He said he would call me back.

On 1-18-2004 Mike from St.Pete called and said he had a check for 1,703.44 but would not pay for the towing or anything else and he would not be in court on 1-22-2004 and good luck trying to get the money owed.

Well here it is the beging of May and still no reply from cottman and still my trans is not fixed. Now we have gone to the next step and got a lawyer. Insted of them fixing the trans they want to add to the amount of what will be owed to us.. And as for the tranzmn, I've been a truck driver for ten years and I realy think I know how to drive a car or r.v. so as for drivers error you are wrong. And for this last time I was told by cottman to take the r.v. to botts. And as for the trans the r.v. was driving fine untill I stoped at a stop sign and then the r.v. wouldn't move so you tell me sir if thats driver error. I never asked you to get involved with this. I hope that everyone that is having problems with cottman will get what is owed to them. Now it will be up to the court's of Fl.

you sued the wrong person, The original shop has a responsibility for the warranty

BADDD MISTAKE TOM Tom~~~~~I called and spoke to mike in St Pete~~~~~Tom,you sued the wrong person~~~~ Per cottman franchise agreement: #1 The original shop has a responsibility for the warranty for the first 90 days ~~~#2 The case was broken in Tenn. from the info it could have been another reason the case broke, driveshaft out of phase or bent, carrier bearing problems. Or driver error~~Yes Tom "driver error" the way this could have proven is if the fracture was diagonal to the engine it shows twisting force to overstress case until it failed. This happens when the park brake is applied "prior" to the rear wheels stopping since the park brake is part of the rear of the transmission,Mike an i discussed this an he had no info reguarding this possible situation. The person who said that it was the flywheel that caused this problem was wrong, unless the flywheel had a major failure and came through the case ~~the diagonal fracture would not be there only damage inline with the flywheels rotation. The other problem was botts truck repair,They wanted to charge 900.00 for 2-3 hours of r/r time way out of line !!! The type of transmission you have will take a caveman with a flat rock and a hammer maybe 1hr to remove since its all out in the open. These take me bout 1/2 hour to 40 mins with problems to get out.You have a 400thm trans with a 454 cubic inch engine.(300.00) for the r/r is very resonable, unless their labor rate is over 100 dollars per hour. (in Calif it is) As you know Carol was useless in this situation between the shops. (Cottman corporate) The real liability is with the last shop that worked on your transmission to straiten it out or diagnose it properly for any future failures. (if its with the transmission or something else?) The situation of money going back to the wrong shop or anything else is between them and corporate.Mike was willing to give back the original amount owed but at this point this sitation was a series of mistakes and unclear good diagnosis and greed by third parties.Tom you may also play a part also, you also have to be honest if you played a part in the case failure. If this happened this is on you and everyone else did their part~St pete would be out of this totally~~I don't know if the second failure lost the case again or it failed (slipped/shifted incorrectly or what) or if the culprit is in the driveshaft or something to do with it~~~This is on the 2nd shop to advise you on this, and it should be a new job, if the case was broken because of park brake apply~~again PROPER DIAGNOSIS may be lacking after the first failure to find the real liability ~~At this point this is the information i have and itz a mess~~~~THE TRANZMN

TOM~~~~~You have what you need after 20 days from the entry of judgement if the shop has not filed a motion to set aside judgement and a appeal. This cost the shop money they cannot get back. After that if this has not happened~~~~~You can have the shop owner served with an order of examination which gives you the info you need to collect the $$$ because you at this point can levy on the assets of the owner~~~~The best is to have the sheriff sit in his place for a few days~~(preferably thurs/fri) at this point "the sheriff" collects all reciepts for those days including the costs of collection.~~~~~~This can all be done by mail.~~~~~~It just takes time (months)~~~~Just keep goin Tom~~~~~THE TRANZMN By the way Tom~~~from the damage Initially/second time it sounds like the alignment dowels were not on the back of the engine block~~~have it checked out to find out if this problem is not still there~~~otherwise it will happen again~~~

Write to your lawmakers about stopping auto repair fraud. Identify yourself and include your return address. Senator Mike Fasano 8217 Massachusetts Ave. New Port Richey, FL 34653-3111 Congressman Jim Davis 3315 Henderson Blvd. Ste 100 Tampa, FL 33609 Congressman C.W. Bill Young 801 West Bay Drive, Ste 606 Largo, FL 33770 Congressman Mike Bilirakis 35111 US Highway 19 Ste 301 Palm Harbor, FL 34684 Re: Regulation of Auto Repair Industry 1) Major drivetrain repairs should be covered by the same Lemon Laws that protect buyers of new vehicles. The number of repair attempts and length of time must be limited. 2) Defects can result in accidents and injuries. 3) Defects can cause severe financial hardships and interfere with work and school. 4) Franchisors must assume responsibility for franchisees' defects. 5) I had an experience ... 6) I know someone who had an experience ... (I spent over $2000 at Cottman and original problem returned twice within a month. They never made good.)
