Today, (12/16/07) my wife and I went to Circuit City in Aurora, CO to shop for a LCD TV and found a display in the store that had a sign for a 26" Panasonic LCD TV for $417. There were 2 TVs below the sign and I picked one up and took it to the check-out. When it rang up at $800, I informed the clerk about the sign. The check-out clerk asked to see the sign which I went and got for her. The TV manager Tom, was standing there and told me "it's our sign and we will honor the price." He said that he needed to have the store manager (Shane Kittel) do the adjustment as the difference was over $50.

When I finally got to speak with the store manager, I was told that they would not honor the price. Further, I was told that I had valid arguments as to why they should honor the posted price, but again, they will not honor THIER posted price. I mentioned that they had a legal responsibility to honor their posted ads etc, and was told that they had the legal right to refuse service to me. In the end I left the store without making any purchase. The "best offer" I got from the manager was to get the TV for $600, nearly $200 over the posted price and $150 over an open-box posted price (though this unit was not open box).

Despite the clear facts that: they put up a display and posted a sign for $417 for the TV; their sign had no exemption dates; their sign had the correct brand name and model # for the TV; the TV manager: Tom, stated that they WOULD honor the price. They would NOT honor the price posted on their display.

Also, I have a picture of the sign and the unit together, and would post it if possible.

I am hereby BOYCOTTING any and all Circuit City stores as they have no concern for the customer, no quality control procedures, and NO Ethics.

Actually depending on the tag itself both of you were entirely right in what your points were. If the tag said that it was expired, which it would say at the bottom left hand side of the tag then the manager would then not have to match the price on that tag. However, if the tag did not specify a date of expiration, then the manager would be obligated to give you the price listed on the ticket. That is one of they ways that they can get around the system on sales that were like that. Also sales run from sunday to sunday, so if you see a tag that has a date prior to the previous sunday, then I would ask before purchasing. I would recommend giving Circuit City another try, and if you come across that problem in the future, which could happen because associates will miss things during the retagging process, then I would ensure that the conversation between yourself and the manager does not get heated, followed by an explanation of that being the advertised price. Most managers will go ahead and match the price of their tags that they have out, even if they are expired. So I would recommend giving them another shot, because you could have just had one of the anal managers. Sorry that that happened to you. Good luck.

After three weeks of continuous phone calls to John Milliron, Executive Response Supervisor at:Phone: 800-251-2665 and Fax: 804-934-3865, as well as complaints to the Virgina Better Business Bureau at :www.richmond.bbb.org; and finally a Press inquiry by Channel 7 News in Denver, I received a call from the Corporate office to rectify the situation. The end result was that the Regional Manager for Circuit City honored the posted price as well as provided a gift card to apologize for the situation. Further, arrangements were made to pick up the TV at the store of my choice and apologies were again made. The regional manager handled the whole situation very professionaly. Overall, if you continue to fight for what is right, keep documentation and keep a cool level head about you at all times, you can prevail. The key is contacting the right people and being presistent. Good luck!
