I am having the same troubles that many of you are having. Mine came through Green Tree Finance/Conseco Finance. I paid off my debt with them back in 2000. A year, or so, later this Cavalry Portfolio Services, LLC calls me on my cell phone (I'm still trying to figure out how they got the number) at 7:00 in the morning. The person didn't even start the conversation pleasantly. He instantly went into accusations.

At first, I thought it was a joke. Then he went on to explain who he was (Cavalry Portfolio Services)and that I owed them over $500 for an unpaid bill. I told him that this debt had been paid off for quite some time now. He said there is no record of any kind of payment on that account. I faxed him a copy of the processed check and that was the end of it, or so I thought.

Almost five years had past when all of sudden I began to receive phone calls and letters telling me to pay this debt now, or suffer the consequences. They really don't make it easy to get a hold of them and when the credit bureaus investigate; they seem to side with the swindlers.

So finally, after months of waiting, I received a letter from them stating they understand that I had the credit bureaus investigate their claims of debt. They said that they were willing to dismiss the debt if I was to provide for them, on a written letterhead from the original debtor, that the debt was paid in full. For those that don't know, GreenTree and Conseco Financial does not exsist anymore. They are owned by someone else now. I'm not sure who. So I as I try to find out how to get this taken care of. The fees keep racking up. Where somewhere around the 700 mark.

Heather had a great response to Calvary... here it is: Immediately send a letter to Calvary via certified mail return receipt telling them that you dispute the debt in its entirety. Demand that they send you validation of the debt via postal mail. Also make sure that you demand the removal of any reference to this account from your credit reports if they are unable to obtain the validation (this one is particularly important). They have 30 days to respond to you. Then about 10 days later, send a letter of dispute to each credit bureau that the account is listed with. Calvary will do one of three things: 1) ignore you completely and post/re-validate a negative account on your credit report, or 2) they attempt to send you bogus documentation to try and prove the debt is valid and then post/re-verify a negative account on your credit report. If #1 happens, send another letter stating that you are still awaiting validation and repeat your demand for immediate deletion of the account from your credit reports. They'll probably ignore you again, but at this point you can prove willful noncompliance of the TDCPA and the FCRA. Take all of your paperwork to an attorney who specializes in debt collection law...can be found on the NACA website. If #2 happens, immediately send them another letter rejecting their bogus documentation. Tell them that the account is still disputed and to remove their tradeline from your credit reports. Sue if they don't respond to your demands. Read up on the FDCPA and the FCRA. I'm advising you to use one of the best protections: you can dispute a debt at any time - they have 30 days to respond either with validation, or a request for more time. If they fail to validate within 30 days or request more time, they must change the account that appears on your credit report per your request (hence my suggestion that you demand deletion) until they are able to send you the validation. Keep copies of all correspondence, envelopes, return reciepts, etc. for evidence. Don't be afraid to get nasty with them if they don't make this go away soon!!
