one year ago, oct 2012, i applied for a loan with roadloans.  they instantly approved me.  they also called me and congratulated me and referred me to carmax, ontario, california.  they also required me to download and fill out a package (approx 12 pages and a image of a $24,000.00 check).  i complied with the necessities and a rep from carmax called me before i went car hunting.  once i arrived at carmax they verified my online approval and suggested i find a car on the lot.  i picked a 2010 dodge charger.  they also required me to put only $600 down. while the car was being washed, we processed the paperwork.  i also reminded the rep that i do have my $600 down payment and he said "i will get it later".  he handed me 2 sets of keys, shook my hand and then i was on my way with my new car. approx. 2 months later santander and carmax kept telling me to return the car because someone on their behalf scratched off my info on my paperwork, i told both parties thats not my problem and it seems very odd.  then they called back and said they printed a new and better contract for me to sign.  i refused but wanted to stay with my signed contract and i was already approved.  i told both parties that it sounds to much like a scam they are doing against me and therefore i will not return.  within a year i never received a payment book from santander then they sent me a letter saying they will not finance me.  i ignored the letter because i have signed paperwork already of approval.  l year later, on 10/10/13 they repossesed my car.  when i told santander they made like they never processed a loan for me and said i am not in their system and maybe carmax has the car.  i would like legal assistance into this matter, its unfair and a scam, adrienne, grand terrace, calif

Check this out champ, u got up at approx 4am, either u cant sleep or stayed on the pc all night but thats not healthy, besides ur the one actually gettin ripped off......of ur life, no psyhcos allowed on my page just people with credentials, expertise, money and good credit, no vicrims like u do i want to hear from, so this site will be requested to block u, u really should hit the dating sites, do more than an anonymous coward that knows norhing, u are not an asset here and ur very illiterate, so be gone, fly the coop, the elevator doesnt go all the way to the top

You are not a cop. You do not make over 200,000 a year

The only thing in this whole report that may be true is that you may have filed a Chapter 7 Bankruptcy.  Which is if that is the case would explain why it took them almost a year to pick it up.  BUT..if that is true for you to think you have some legal recourse against them is laughable at best.  Of course if you don't believe me why not talk to your BK attorney?  Or can we guess that the next post is that you did and even though you came here looking for advise the attorney already told you that you can sue them for 200 Million dollars.

look, mr, i was approved, thats all that matters, given the keys and was on my way.  i've bought many cars over the years and yes, they so called wanted to scam, the only comment i had for them is come get the car, they have my addresses and if i never made a payment it was and wasnt my car.  no i dont fall for scams as maybe you sound like you've been had a few times.  they have no room because the car was filed a chapt 7 bk on it.  im not gonna be dragged to court for anything.  yes the car depreciated due to their scam not mine, what was i gonna do? sleep in the car? no, i drove that sucka, thats what a car is for.  no i donot accept and by right still can deny a new contract.  you pay one visit to the dealership, paperwork done and thats it.  the rep didnt take my down payment then thats on him, i dont have to return anywhere for humiliation, they have an option to come get it, no i didnt get a payment book so im not gonna send $800 when the monthly payment is estimated at $400, you wouldnt either, if any action was gonna be taken, they would have done it but instead i filed with the federal courts and thats when they stopped callin, i dont have to sign anything as well as its legal to turn down immediate medical attention.  as for dense? or a joke?  sounds like you participated in something like this yourself or you are one of their officials.  im a cop so i know a rat when i smell one........rat.  they knew i didnt have $24,000 when i entered the lot, they gave me the keys, you cant sue me for mileage or depreciation, that happens automatically.  and yes both contracts approved me, its just my choice of which contract i wanted, so i chose the first one. i dont have time in my busy schedule to participate in a scam toward me.  let it go, i had a free car for one year and thats what they get for being so dang untruthful, they tampered with the approval paperwork and my signature does not appear on anything else of theirs, yes a contract is a contract, i was approved, when i contacted them they said return or they will come get it, so they let me choose the choice which was "come get it" and they never did until a year later, i didnt hide the dam car inside my home, i parked it on the curb with both keys inside and they chose to leave it, the car is listed in bk so they can take me to court if they want to, they dont stand a chance, as far as saving money, look dear, i make over 200,000.00 a year, i dont have to save nothing, its not about the money, and yes i bought a new car...........that one!!!!!! that i was approved for, how dense can you be

Anyway, mr, with no life, i have 3 cases out there, heard if Joshua Ritz? Nah, u wouldnt cause ur on ur pc too much, ur not a money maker, ur a car dealer from the deep broke and poverty south, oh, i can send a pic of my bank acct and check stub, we make as much as we want, or maybe ur a convict, they hate us the most, i will not even speak of this madder to u no longer, ur a bored man, no looks, not gettin enough of nothing, saaaad, so over one day they just offered the car back but i want a black one instead and i want it fresh,

i knew it would work out in my favor, so mr lonely, u mustve been ripped off greater than i have that caused u to be so bitter, hey get over it, a loss is a loss, im in california, we are all about great careers and money, i can even send u a blow up doll if u like, get off this site mr mad underpaid farmer car dealer, millionaires dont impress me, billionaires do, a million is peanuts like the ones u grow, only people with no life stay on their pc with no money and nothing to do,

yes i have legal assistance now and they are seeing it my way and yes it cost a pretty penny to retain the best lawyers out here but u are trailer park material, so go feed ur dog spot, take a bath for once, and quit gettin so excited because someone is paying u attention on the internet, i can buy u if i want to, call chp, dept of corr, etc and see how much deneiros we pull in annually, it would make u piss ur pants, then u really be mad, where ur at theres no crime in ol mayberry and thats wht u all are underpaid, better hurry and get off the computer before they bury u and that pc together......broke and lonely

 You did not make a single payment on the car for a year and you want to sue THEM?  Seriously...you can't be that dense...or perhaps you are.  Who knows?

I really want to know exactly how this "scam" works in your mind.  A lender says you are approved, you get the car, and then a month or two later they say you aren't approved.  So instead of returning the car you keep the car for a year and don't make a single payment.  Yea..great scam on "their" part. 

Well guess what I am sure as a responsible person you were putting aside an amount every month to be able to pay them when you got caught up, and calling them so you can make your payment.  You did that right...no I am sure you didn't.  Because over a year that would have been a good 2 or 3 thousand dollars and more than enough to put a significant amount of money down on another car, or heck..even pay for a car outright.

Now, not to say you won't end up in court..it will just be on the other side, when they come after you.   You see had you turned the car in when they requested it it would have probably have been a "wash" in that they would have just taken the car and you would have walked away.  But since you think you were being so "smart" they may have a right to claim that it was in fact your car and you failed to make a payment on it(yes even if they didn't send a payment book it is still your responsibility to contact them).  If this is the case the repo is probably valid and like any other repo they will selll the car at auction(about 1/3-1/2 of the actual blue book value) and you will be responsible for the difference.  If you fail to pay it they can(and probably will) take you to court.  Oh and the judge is not going to be happy when they hear you kept the car for a year without a single payment.

Oh and as an FYI if you read the "contract" you signed in detail you will find that there is a provision that states that the loan is still subject to final approval and if you can't get approved they have the legal right to cancel the agreement and you must return the car.  

Do you know what the real kicker is though.  It is very possible that the dealer used a "spot" delivery to get you into a car that they knew you wouldn't be approved for at the terms you were given.  They did that so that in a few weeks they could come back to you with a "better" deal that since you have the car most people would sign the new deal.  So while you were onto them and what they may be trying.  This while it is used by less than ethical salespeople it is legal because of what you signed, and you could have just walked away.

Santander never sent me a payment book, they wanted the car that i got approved for and wanted to make my payments, they gave me no solid reason for doin this after approving me, yea, seems like i wasnt the looser her and a matter of fact the car depreciated approx 4 thousand or more after a year and they cannot report to credit agencies on me i just want consumers to beware of this scam, i do believe i am the winner in this cause i had a free car for a year but im angry because i was approved by two other banks then lost their offer due to time limits, i couldve chose one of them but instead i get this nighrmare

 From your post, it sounds like you didn't put down the $600 down payment and you didn't make any payments for a year. If that is true, than you don't have any reason to be angry at Carmax or Roadloans or Santander. If I misunderstood your post, please clarify.
