My wife and I filed bankruptcy to avoid a foreclosure with Countrywide Home Loans. We filed a Chapter 13. We actully wanted to exclude Capital One, because our payment to them was not a problem.

We have come out of the bankruptcy, which we stayed in for about 5 months. We are working things out with BankAmerica, the current owners of Countrywide Home Loans.

After coming out of the bankruptcy, we were in the process of calling all of our creditors, when we got a call from Capital One Auto Finance. We were told that we had to make payment that week or the account would be charged pfff and we would face a repossesion. We told them we could make the payment 9 days later, on the 19th, which was a pay date.

We met with a lot of resistance on the low levels of customer service. I had to get on the internet and find a way to contact corporate.

I finally found a way and ended up talking to a lady named Kristi. She initially told me there was nothing she could do. Then, I told her we could make a payment on the 19th of June and the 3rd of July. She said ok. She said as long as we kept our arrangements, everything would be alright.

On June 24, 2009, we were ontacted by Capital One Auto Finance again, and they demanded more money now. I contacted Kristi and she changed her story. She said that she put the hold on the account for that one time only. She said they could not wait another nine days. However, she was not telling the truth. I told her the same thing I had told others in the company, which was that we did not want to lie to them, that we could make the payments to them on the dtes stated without fail, and reminded her that we had flawlessly paid them over $21,000.00 already.

I suspect that they are wanting to repo our vehicle in an effort to collect more fees, etc. We always paid on time. The only reason we were late was because of the bankruptcy.

I also told her that we would make an additional payment on July 17th. This payment is not even necessary to bring the account current. The July 3rd payment would effectively bring the vehicle out of foreclosure status, according to Kristi and others.

I told her we want to pay them, get our account back on track and move on, but she is sticking to her revised version.

As an ex employee of capital one auto finance I can tell you one thing, capital one does look to repossess cars because lost that capital one takes is far greater than any fees that you incur. Did you make the first payment on june 24th as you agreed? If you didnt your promise to pay probably broke and as soon as it does we start calling again and will be less lenient with you then before. I hope you get your issue resolved but just be aware that capital one is not out to hurt you.
