My family and I have lived at 314-7028 17th Ave., Burnaby, B.C., Canada (Byrne Creek Housing Co-op) for about 2 years from August 2000 up until mid May of 2002. When we moved in, we mentioned to the Maintenance Committee IN WRITING and verbally several times about the poor condition of our units' carpeting, but nothing had been done about it. Being as we didn't own the unit, we let it go in the comfort that we had reported it in writing to the Committee.

Two years later when we made plans to move, we met with Judy Paden, the new head of the Maintenance Committee. She told us that we shouldn't be looking at more than $60 to $100 to clean our share of the carpet cleaning. When we received our security deposit a month after moving out, we'd found that they'd withheld $375 for "carpet restoration and general unit cleaning"! I should mention that we'd spent around two weeks cleaning the unit and were told by several people that aside from the dirty carpet the unit was looking very clean ... yet Zlataa Ana Todorovic of the Maintenance Committee found it fit to charge us an extra $45!

I appealed this nonsense to the Co-op Board requesting a refund of $300 (leaving them with $75 for our share of the carpet cleaning), but to no avail. They simply ignored the facts THAT WE HAD IN WRITING and put it down as "essential basic carpet cleaning".

I understand that we aren't the first tenants that they have done this to, withholding large sums of money to repair damage done by PREVIOUS tenants to upgrade a unit. I find it completely outrageous that these people are getting away with what basically amounts to as theft!

Being as I'm getting nowhere fast with these dishonest people, I feel it's time to seek my financial satisfaction elsewhere, through other means.

I thought I would put your name up here also.  I did review the documents you put in your statements.  There was NOTHING in the file except your letter to the Coop that states the carpets were dirty when you moved in, the only note on your file was that the previous tenants had the carpets cleaned and your letter had no merit!  There were no notes from Tracy as you mentioned..........interesting that you state all these FACTS however I have all the paperwork and there is no documentation there except that the place was dirty and you would pay to clean it and pay for carpet cleaning.

Well, 5 years have passed since my first posting before getting this reply from Judith Paden. We are now property owners and landlords, and hopefully will never again need to deal with liers and cheats in the rental world such as Byrne Creek, Judith Paden and Ziataa Ana. As I mentioned in my initial report, the carpets were already badly stained with pet urine etc. BEFORE we moved in. We still have the original paperwork documenting this, signed by Tracy who was in charge of the maintenance committee when we moved in. I was assured by them in writing that we would NOT be charged for the damage. If we hadn't need to move out of province we would have taken all those *&*& to court and most likely would have won. We did initially request that Byrne Creek give us new carpeting since the carpeting was so badly damaged and we were denied. We said we'd live with it as long as we don't need to pay for the repair when we moved. A new maintenance committee takes over and charges us anyway when we moved. We are clean, responsible people and have never had damage deposits withheld from us back when we were part of the rental world ... until that dump Byrne Creek. Let this be a warning to anyone thinking of renting there. Say good-bye to your damage deposit because they will tell you anything you want to hear to get you in there, then they will take your deposit money when you move, using any excuse they can come up with. These people are greedy, self-important, unscrupulous bastards and I found many of them seemed to be sick in the head with way too much time on their hands. Rob Edmonton, Alberta

I have just viewed your statement for the first time. Yes we "The Coop" did hold the said monies from your share. I said I would get your carpet cleaned the cheapest I could. Your unit was extremely dirty and the carpet has to have restoration instead of just a clean. In two years you hadn't cleaned it and the apartment was the same. You may have spent two weeks cleaning but the apartment was not clean and we had to hire a cleaner. I understand everyone's idea of clean is different, you were in the middle of moving and in a very big rush. I thought just a carpet clean would do it, I consulted an expert and he recommended restoration, it was so filthy, with much staining! I'm sorry you felt "ripped off", but it was your responsibility to restore the unit to the previous state when you occupied the unit. You didn't live up to your end of the occupancy agreement, so instead of complaining that you were ripped off, why don't you step up to the plate and take responsibility for your actions, or in this case inaction!
