The lies started right before my pool was to be installed. One that got me i was told they had to do extra paperwork because i owned the home but not the property, and i thought that was stupid, its not a mobile home.Thats when i started checking things out,and i am glad i did.

The law firm i went to was on the cover of a 2006 Law & Politics Magazine as Super Lawers for big cases they've had. So they are who i am using, but they need everyones help. At first my Attorney did not seem very interested, but when i showed her the second time what i uncovered now they are.

I E-Mailed this web site about a week ago for people that had information that might want to contact me,but have not yet recieved a response back yet from them,so now i will fax them. I have been doing most of the footwork myself showing them there is a case here.

I can't release all the information here, because i know Blue World looks at it.

Mark, I didn't get sucked into signing a contract with BWP. As soon as I heard the price from the salesman, I called our appointment to a close. I could install an inground pool for that kind of money ($16,000 !!) See my new rip off report on here also. This company has openly admitted that they run credit reports before sending out their salesman to verify that the consumer is the homeowner as standard operating procedure. This is a violation of the FCRA. They are not allowed to do this under the law. I have filed my own compalints (BBB and FTC) against them for a willful violation of the FCRA (Fair Credit Reporting Act) Section 604 (Permissible Purpose for consumer reports). I'm also debating whether or not to sue them for violating my rights under the FCRA. They responded to my complaint with the BBB, quoted (convoluted) sections of the FCRA and stated they were "100% in the "right"". I did not accept their response and rebutted. See if your attorney's are interested in this: I'm sure there are a whole slew of people across the U.S. had BWP come out and didn't purchase pools. These people probably don't even realize their rights have been violated. Talk about a class action lawsuit !! ANYONE who has had them come out to your home and they ran a credit report on you and you did not purchase a pool from them; BWP violated your rights and you do have recourse Under the FCRA sections 616 and/or 617.. This is a direct willful violation of the FCRA Section 604 (a)(3)(F)(i) which states they can run a credit check on you if they have a legitimate business need and you initiate a business "Transaction". The key word here is "Transaction". There was no transaction between us, just an inquiry. Futhermore, I specifically told them I did not want them to run a credit report and refused to supply my Social. This puts them in violation of FCRA Section 604 (c)(1)(A) for which there is recourse under Sections 616 and 617. To further back up my claims see the ftc staff opinion letters: http://www.ftc.gov/os/statutes/fcrajump.shtm or http://www.ftc.gov/os/statutes/fcra/index.shtm scroll down the page to bottom third of page on left side of screen and look for Section 604(a)(3)(F) Legitimate business need, then read letters Coffey (02-11-98),Kaiser (07-16-98),Shibley (06-08-99).
