Being a Best Buy Mobile employee, I can understand customers get confused about data plans. There are three phones on (soon to be four, when we get the iphone) ATT that are in need of a special data package ($35 a month per phone) -- the Palm, Blackberry's, and the BlackJack 2. They are not required, but I highly recommend them if you get any of the phones listed. The other phones DO have medianet unlimited for $15 (but medianet will not work on the listed phones)...they also have medianetmax unlimited for $35 a month (which includes, as listed on the AT&T wireless website, unlimited high-quality video with CV, unlimited mobile web with MEdia Net and unlimited access to email, games, ringtones and music as well as unlimited messaging - text, picture, video and IM with anyone in the U.S.). And sadly, activation fees are with all carriers (all carriers, excluding Verizon also have an upgrade fee for when you purchase a new phone.) This is nothing we can control, it is a carrier fee that will show up on your bill.) I really don't see why he would lie to you, I just see it as a misunderstanding. He gains nothing by lying to you, he is non-commissioned. Activation fees have nothing to do with what carrier you are previously on. They are the same when you switch to AT&T whether you come from Verizon, Tmobile, Sprint, etc. So, again, I apologize on behalf of Best Buy Mobile, for the misinformation you received.

Yes, I agree that it is the responsibility of the employee to properly explain the phone plans to you. If I was told by an employee with confidence that something was half of the listed cost and later on not guaranteed such price, I would immediately demand to speak with a supervisor or member of management. However, I cannot honestly believe that you've had a cell phone before and not been aware that there is an activation fee. That is the way of the cell phone world, and one will exist regardless of which retailer you go to. I'd say he was doing you a nice favor by waiving the activation fee, considering he had fouled up by misquoting the data plan. Also, for future reference: When speaking to management regarding phones, make sure you are speaking to the manager of the Best Buy Mobile department. The general management will not be able to easily resolve your issue since they are considerably less knowledgeable about phone service.
