REBUTTAL TO RIP OFF REPORT
JANUARY 28, 2011
My name is Larry Foster (not an anonymous poster to this forum) I am a member of JOK Investments LLC. I am posting this rebuttal to correct the erroneous remarks posted by the anonymous post.
All comments will be in RED BELOW EACH COMMENT
Here are the facts as we have been able to find out so far:
- Beach Wood Homes LLC is owned and managed by Mike Blowers (aka Seattle Mariners announcer).
Mike is a 1/3 owner of Jok Investments and the Managing Member (see public record)
- MikeBlowers also owns the controlling shares of Keymark Real Estate, JOK Investments LLC, Cleanup LLC, Mountainview Construction & Development LLC, and a host of other shell companies.
JOK Investments created additional LLCs per advise of Attorney for each Business owned, standard business practice. None of these entities are Shell Companies (See Public Records)
- Mike Blowers is partnered with Larry Foster and Garret Alwert in most of these other companies.
Factual Statement (see public records) Mike is Managing Member
- Mike Blowers replaced the previous management staff at Beach Wood Homes with Larry Foster's wife and relatives in the late winter / early spring of 2009 and apparently setup JOK Investments LLC as the controlling party.
Incorrect Statement: Beach Wood Homes Operation Manager and Partner Jim McCullough (McCullough and Associates Inc. UBI # 602388336) withdrew and left company for violating his fiduciary responsibility to the LLC, Beachwood Homes. Violated copyright law and caused BWH to be sued. (See public records) Beach Wood Homes was a passive investment of JOK Investments. Larry Foster was tasked to hire and manage companys sales efforts for a period of 4 months and recruited (3) sales people to BWH staff. Kim Foster was sent to BWH to audit the finances of the company for JOK management. Neither Kim nor I had any management responsibilities. We were tasked by JOK to assist in sales and to audit financials of the company when BWH made a capital call to JOK. No staff was replaced.
-Blower's staffapparently discontinued payment of many or most subcontractors and suppliers in the spring of 2009.
Incorrect Statement: See Public Records no liens are active against BWH. Payment arrangements were made with all vendors.https://fortress.wa.gov/lni/bbip/ViolatorsSearch.aspx
- Blower's staffapparently ran a cycle of hiring unsuspecting subcontractors and suppliers and failing to pay them for as long as possible.
Not factual (see public records)
- Beach Wood Homes continued to demand and collect payments from homeowners for these unpaid servicesuntil filing for bankruptcy in the fall of 2009.
BWH filed for Chapter 11 reorganization to protect the ability of the company pay off all liens for homeowners and creditors as Law Suit (see above McCullough and Associates) would have closed the company.
- Blower's staff routinely stalled and avoided honoring lien release requests from homeowners to keep the shell game going as long as possible (when pressed harder they also exercised a clause in their contract to force additional draws from homeowners without proof of previous payments to subs).
Incorrect statementall contract terms were enforced per mutual agreement. Basic contact laws were observed.
- Blower's and hisstaff repeatedly misinformed homeowners as to the realreason for substantial delays (i.e. lack of payment) while at the same time misinformed their subcontractors and suppliers that the reason for lack of payment was because of homeowners failing to pay (a completely false statement). When cornered with the facts, they switch to blaming a fourth partner who was forced out of the company prior to the misappropriation of homeowner's funds.
Incorrect statement: Business relations between BWH and its vendors or suppliers were confidential as is standard business practice and the person who made this posting has no direct details from any vendor.
- Many
Washington homeowners are now stuck with unfinished homes and substantial liens.
Incorrect Statement: (please see above link to verify with State of Washington)
- Subcontractors and suppliers are now attempting to foreclose on these liens, and many homeowners may lose their homes even though they paid for them in full.
Incorrect Statement: No Home owner has lost their Home.
- Blower's lists JOK Investments as the primary creditor in the bankruptcy documents (i.e. himself under a shell company) ahead of all other subcontractors and suppliers.
Correct Staement as JOK Investments LLC had invested hundreds of thousands of dollars into BWH
- Blower's apparently could not account for where much of the missing money has went during the initial bankruptcy hearing.
Correct Statement: JOK Investments was a passive investor in BWH
