I purchased a house and the liner in the bath tube was leaking.  I contacted the previous owner who mentioned Bath Fitter of Ridgeland, MS installed the bath liner.  The previous owner also mentioned the liner was leaking before and bath fitter came out and repaired it 5 months prior.  I contacted James Cole who said the policy states once a house is sold then the warranty is no longer valid.  


 


He said to repair the liner would be a 4 hour job at $75 an hour and their work would not be warrantied.  If the seal came up again he would charge $75/ 4hours totaling $300 not including tax and supplies.  I asked how much it would cost to get a warranty on his work and he said around $5,000.  I also talked with the lady in the office and she said the particular liner that is in my bath is prone to leak.  She also said the repairs would take only 3 hours but James insists on 4 hours of labor.

This unit was installed on 12/17/2010.  It was sold with a lifetime warranty to the original purchaser.  Our warranty does not transfer to a new home owner.  On 3/27/2014 I went and met the new homeowner at his home in Carthage, MS to discuss the issue with the tub.  The homeowner verbally agreed after our conversation to pay for the repair and understood the repair was not under warranty.  In regards to the repair price, I did quote 4 hours at $75 but also stated that if it took less time to repair I would only charge you for the time there and if it took longer than 4 hours I would not charge him any extra.  The homeowner did ask about purchasing a warranty, and I explained I had not had a question like this in the past and would have to check to see if I could even extend a warranty to him.  He brought up that I stated it would be $5000 for a warranty.  If I remember the conversation correctly he asked if the price of a warranty would be $5000 and I stated if it were approved the price would not be that high, there must have been a slight miscommunication error in regards to this.  The unit that was installed in 2010 has been modified by someone other than a Bath Fitter employee.  A piece of glass has been glued into a window that is in the unit, this could be the cause of the issue he is having and is not part of our original install.  The desired settlement he has proposed, for Bath Fitter to do warranty work on a unit that is not under warranty free of charge cannot be honored.  I would still honor my original proposal in charging $75 an hour and not to exceed $300 plus tax for the repair of the unit.  

 

This same complaint was logged at the BBB on 3/31/2014 and it was removed from their system as the complaint filed did not meet the requirements due to the warranty not being transferrable.

 

We at Bath Fitter take all issues very seriously and try to resolve all issues without involving the BBB or outside interests.  To date in the last 3 years we have had two issues logged and resolved.  We pride ourselves in doing the right thing for our customers without regard to profit, but in the case above we have a situation where we are not able to honor a warranty that does not exist.  We still maintain an A+ rating with the BBB.
