Complaint Review: Bank of America - Semi Valley California

Shortly after moving into our new home we found ourselves having financial difficulties. We struggled to catch up. At one point we did catch up when we sent in almost $5000 in payments. We fell behind again when my other half along with 59 other guys were laid off . at that time our mortgage company was Taylor bean ,& Whitaker. We tried to get loan modification during process we were told everything would b put on hold not to worry about making payments We were declined not having enough income. they filed bankruptcy our loan transferred to bank of America.

When we found out our cashiers check for almost $5000 was never applied to our acct we had the bank do an investigation. It took 3 times of starting investigations before they supposedly found it. However each time I called and asked for proof I never received any!

My other half was injured on the job, had to have surgery, and we lived off workmans comp for a year if u can call that living

We tried to get modification but it was declined due to not enough income.

My other half finally back at work we started trying again this time they kept us in the modification for at least three months at a time. Then would decline and say we were missing paperwork and we would start over.

After that we made sure they had everything and every page was signed, dated and had acct # on it. The next time they declined and said we were missing our income verification.

Our acct mgr found that they did have the income verification info. She informed me that we would have to start again because it had already been declined.

The last and most recent attempt at modification was declined saying we didn't have enough income. When I discussed it with them they found they had screwed up and only had our income at 2,700 a month. Which I corrected with them. The lady said we couldn't start over again but if I could give her all income and expenses over the phone she could run in through again

I did the best I could to pull all info out of my stressed out brain. She told me we made too much money! Therefore we didn't qualify for modification! She told me that we would just have to pay payments and catch up. I explained to her that yes we could now afford our payments again except we would never be able to catchup every payment would b late. This was enough for me and my family of 5. I told her that I thought it was best to do the short sale. She said she would get it started and that I would b getting a call from that department.

A week later I received a letter and it said they would be contacting me shortly. A week later and our foreclosure date coming in approx month, no surprise, no call! I called them the guy said the papers were there but for some reason it hadn't been opened! He told me he would get it started and I would hear from him within 8 to ten days.

We Have 3weeks and a couple of days till foreclosure! We are working hard to find another place to live and start packing up our lives before the foreclosure! Yes we have given up. We can no longer deal with all the stress. It was not the banks fault we got behind however, every time we went through process we were lied to only to start again and end with same results! It would be nice to see proof of the pymts they say they found but I don't see that happening.
