Bally Total Fitness is currently attempting to enforce a contract that I never signed.

In August 2008, before utilizing Bally's facility, I told the sales rep that I only wanted to use the gym for 3 to 4 months, since I will be moving out of New Jersey by the end of the year. After trying to persuade me to join a long-term membership, the sales rep asked for my credit card and driver's license. She told me that that month's fee will be charged onto my credit card. She took my photo and gave me a gym card. "I never signed any documents or contracts."

I no longer use the gym, and they are trying to enforce a $3,500 contract against me. I am appalled since I never signed any documents.

I am aware of Bally's deceptive business practices in attaining customer's signatures and enforcing them against the customers. However, in my case, I never signed any contract or document and they are still trying to enforce a contract against me. This is no longer an issue about poor business practice. This is an issue of a crime of fraud by way of forgery.

State law enforcers need to investigate on Bally Total Fitness's business practices. These criminals must be prosecuted since they are in a position to easily harm other potential victims. There is a long history of fitness centers abusing their customers, and there is a strong need to deter these sort of criminal conduct. I hope this matter would be further investigated to prevent the continuous deterioration of consumer trust.

You can send a copy of your Drivers License and your signature five times on a blank piece of paper, so they may compare it to the contract that was entered in thier system. If the signatures do not match, the contract is normally cancelled and any derogatory remarks on the credit report are removed. Bally's tries it's best to avoid cases like this. But it is also the consumers responsability to reveiw any paperwork they sign, whether it be a gym membership or credit application.
