My story begins in 2010 when I purchased a Dodge Viper from Mercedes Benz of Delray Beach, FL. Initially I financed the car and a month or so later I paid it off. Just after paying it off I am hit with a lawsuit by Chrysler Financial saying they want the car and I do not own it. 

Immediately I go to Mercedes of Delray and the manager, Ralph Mesa, tells me "don't worry, we will make this right".  Chrysler states the orignal owner of the car defaulted on the loan and then the car was sold by a towing company and then traded in to Mercedes of Delray who sold me the car. The Chryler lawsuit had been going on since early 2009, long before I bought the car. 

I have offered to MB Delray since day 1 to take the car back and get me out of this. I did not buy a lawsuit, I bought a Viper. They refused and now after trying to work things out with Chrysler, I am suing AutoNation and MB Delray. Their attorney, Richard Ivers, rather than helping keeps filing Motions to Dismiss and drag this out for me.

I am up to $20K in legal debt because of them and have a car I cannot sell.  I have written to the AutoNation CEO, Mike Jackson and he has never responded to me, despite responding online to others. We now have another hearing date set for late November and that is just to get passed another one of their Motions to Dismiss.

How much longer can this go on? If they wanted to do the right thing they should have taken the car back and worked it out with Chrysler. I even suggested given me a car of equal value...still they won't do anything.

They are going to spend more fighting this then it would have cost to make it right. Until a court decides I have what amounts to a $70K paperweight in my garage thanks to AutoNation and Mercedes of Delray. Every GM at other dealers I have spoken to said they would have taken the car back. I guess AutoNation And MB Delray could care less.

I have read your ripoff report. I'm going to help you get to the bottom of this issue and charge you nothing I have sent you an email that has my phone number please call me as soon as you get it. I find it peculiar that a finance department can get you financed on a car and then you have a problem getting your title after you pay the car off.  I have a sneaky suspicion that it was at least return and they sold it to you without having the title in their possession that is my opinion. 

I will do whatever I can to help you get to the bottom of the issue and find out who done wrong !  I called the dealership and they refuse to talk to me about it. It is my opinion that somebody screwed up in the dealership does not want to acknowledge it.  If Chrysler is involved it seems to me that it might be a lease return and somebody mistakenly sold it to you thinking it was a piece of inventory that belong to the dealer. 

I personally will assist you in getting to the bottom of this issue and we will get it resolved. I will not stop until this issue is cleared up.  If I were you I would keep that car under lock and key until the issue is resolve. Do not drive it if it all possible. Keep it in your garage locked up do not park it outside anywhere. 

I have known cases like this where the customer left the car outside in the repo man snatched it for the lender.  Do not release any documentation that you have in your possession regarding this car.  Also request from your state any copies of records that they have of you having the car registered in your name. 

Documentation documentation and more documentation create a clear paper trail of you owning this car

I don't know your name but my name is Stick. I'm going to speak to the editor of ripoff report.com so I can contact you. We are going to try to help you with this issue. I feel by us contacting the people at AutoNation this issue can easily be resolved. As usual, I am going to donate my time to help you get this issue taken care of.

I will be in touch with the dealership next week. I am the automotive investigative advocate that has worked with ripoffreport.com.   We come to the defense of of both the consumer and the auto dealer. In our opinion, sometimes the author is wrong and sometimes the dealer is wrong.
