in july 2010 I bought a car from auto smith in union city finance through automobile acceptance 2006 ford taraus 73,000 mile down payments was made and spot inpsection was made and all payment was made on time or before time, they even me a coupon that if all payments was made on time for 6mos  i will get  up to 400.00 of  car maintence  service. well due to I made all payments on time in feb  of 2011 took my car to auto tune spoke to supervisor advised him want the car check inside and out motor , trans, tires oil and all other fulids to be check so that i can use the 400.. wisley, i was told brakes rotors need to be change, two back tires was need and oil change and everything was fine tune wasnt needed at that time and all fluids was good and motor and trans was good due to no check engine wasn't on.  ok June 6,2011   driving home from work and stop at red light and would not go on green light  would back up and would not go forward had to have my car tow home to find out that the transmission went completly out call auto smith  and was told to call auto tunes who told me to tow in to their office forest park  and once we pull up after the the tow trunk drop it off we was told that the tramission was gone and it was going to be 1800. to fix remind up we pull up just in time to see the supervisor come out of the building sit in the car and crank it and go back in the building back into his office on the phone and we walk in right behind him for him to tell us that and without putting car in a bay on a lift to be look at.  went  to  automoblie acceptance in riverdale to speak with a superviosr  and was told that auto tune can call to make arrragements with the price with them and they will let me know how much to pay  but I couldnt even thou I'm the one making the car note payments each month ask well since it havent been a year since i had the car and the transmission just went can they just put me in another car for the same price said no that i was still responsible for the car i have and car note will still have to be made on the car on the due date which was June 10th 2011I advise them that they are financing lemons cars and thats is alright with them the lady replies that they  only deal with the money part of it not the repairs. due to i file ch7. anyway i told her auto acceptance, auto tune and auto smith that they can keep the car. DO NOT BUY OR FINANCE NOR GET REAPAIRS  DONE AT ANY OF THESE BUSNIESS RIFF OFF AND MONEY HUNGERY  AND THEY DONT CAR ABOUT THE CUSTOMERS THEY PREY ON THE NOT SO PERFECT CREDITORS ........

first of all it did, come with a warranty,

Gee don't you think it would have been nice to mention that?  If it came with a warranty and the warranty did not expire and does apply to the part that needs repair then yes they should repair it under that warranty.  But unless that warranty says you get to exchange it for a different car(which I have never seen) your demand was silly and unreasonable.

- Go ask your lawyer.  They will tell you that they did in fact repossess the car.  By you leaving it there it was a voluntary repossession but a repossession none the less.  The effects of that depend on when you filed for Bankruptcy.

You make it sound like that is a good thing.  You actually never mentioned the date of your Bankruptcy, so just curious as to when you filed.

- Let's see the other car you had for 11 months before it had problems.  If you got a car after you turned this one in, at most you have had it for about 2 months.   Come back in another 9 months and see if you feel the same way, which by the way if you do....great.

If you were able to respond to it, then you was able to read it, so that's why I keep it on your grade level!  I see you didnt respond to my response, only thing you can come up with is sentences and third grader. Find something better to do with your time,  like listing  good finance companies to use or great car lots to go to. You so smart and know everything write something thats going to give good information to help people instead making irrelevant statements that concerns nothing. How are the car dealership and finance companies in Orlando. This is Ripoff report .com not irrelevant loud mouth's reports.com

first of all it did, come with a warranty, second, the report was about all three company not just the finance, read into it  not thur it, the treatment , the lies and the quality of the cars they fianance   was the point, and they didnt repo it i left it there. thrid i have fianace a car before as a matter a fact it was as-is and never broke down far as motor, tranmission nor other major parts of the  car went wrong, and the the car was paid off in three yrs  on time with no problems. I use this company thur a advertise on the radio which was an bad idea never will do them again and wouldn't advise any one else either. and as far as my ch7 yes it was file and it was file at  the right time, the Fianance company DID Not Show so there for no agreement was made and thank to my Lawyer (you do know you can get one those so therefore they can help you understand the   ramification  so YOU dont have wondering if I  even understand the ramifications of that.

  it was up to me to return the junk pile or keep making the notes on time as i have been doing since i bought  the car but  even when the pile of junk broke down, so i did the responsible  thing by returning it to the junk yard that finance car per lawyer's  agreement.
 so im paying for the car when they sell to whomever going to buy it from the auction nooooo,Im protected by law sorry,,,, do i have a ch7 for the next 10 yrs yessss, is my score and life is in rebuildng status yessssss,,, do i have something descent  and dependable to ride in yesssss,  oh and no car note forgot to mention that,'  loving life and things i have in it , lesson learned from these company will never use them again and wouldnt advise anyone else to do so, best to go to a car dealership than go to a block finance company buy here pay here  it will be well worth it in the end. thanks for you input thou maybe it will help someone else.

While what you tried was interesting it just shows how you don't have any idea of how car financing works.

When you bought the car you bought it "As-Is".  That is unless you specifically have a written warranty, you are responsible for all repairs.  Your transmission goes out after 11 months and you want them to just put you in a different car for the same price.   Great plan if it worked.  But I don't know where you got the idea that a lender is responsible for the repairs of your vehicle.  They only loan you the money for the car.  If it needs to be repaired you are responsible for the repair, and are still responsible to make the payment on the car.

You are with a Sub-Prime lender but no lender would do what you wanted.  However, it does show that you had issues in the past.  The Bankruptcy statement is confusing as to when you filed and wondering if you even understand the ramifications of that.

If you filed a Ch. 7 in the past and got this car after the BK, if you stop paying they will repossess the car and you are still responsible for the balance of the loan after they sell it at auction.  So you not only have a BK but a recent repossession.  In which case you can forget getting anything near a decent car for a decent price/interest rate for several years to come.
