I purchased a used 2014 Maserati quattroporte gts from Miami Auto Imports sight unseen from Texas. The car was advertised among other things to have an active Maserati factory warranty, All books, tools and accessories, Only serviced at certified dealer, cold weather package.

I asked via email during the process if the car has any repaint, touch up or repairs. I asked for them to tell me what the tire wear looks like.

They told me that the tires were near brand new and that nothing that catches the eye. I come to find out that the rear bumper has been repainted and when I received the car the front bumper cover was peppered with hundreds of paint chips from rocks. I have never seen a bumper cover with this many paint chips in my entire life.

After I received I took the car to Discount Tires to have the tires inspected and to be educated on tires. As Discount Tire explained it, the tires came new with a 10/32 tread. The front tires were manufactured in 2015 and have 4/32 and the rear tires were manufactured in 2016 and have 5/32 tread. Consumer report and other research state that for the tires to be safe they need to be replaced at 4/32 and the tires will fail the safety inspection at 3/32. The condition of the tires is in complete opposite of nearly new.

I requested all the service records (as they have stated that the car was ONLY SERVICED AT CERTIFIED DEALERS and the law requires them to have material proof in order to make this statement) they sated that all the service was listed on the CarFax which has the last sericeve listed in 5/11/2015 at 8961 miles.

I received the car with the repair wrench icon which is similar to check engine light flashing that the car was past due service. The car also failed its inspection because of this.

I can not locate the winter package which the car was advertised to have a heated steering wheel and this one appears to not have it.

I had been seriously speaking with about 5 different dealers asking various questions and negotiating price etc based off of what I was being told as far as the condition of the different cars and the color, options etc.

The dealer refereed to the car verbally as being perfect etc.

Luckily I have much of this in email and the advertisement listing.

I agreed to purchase the car based off of the description of the condition of the car and they agreed to sell the car to me as described. I obtained a loan and sent them the check. They endorsed the check and deposited it. Never once had we agreed to buy the car AS IS without any warranty, but after I had already purchased the car and they had already endorsed and deposited the check they demanded that I sign and agree that I was buying the car AS IT WITHOUT ANY WARRANTY which is opposite of how they advertised the car. They went so far as to question my ability to read the document that clearly stated AS IT WITHOUT ANY WARRANTY. After about a dozen emails where they question my ability to read and state that the car has an active Maserati Factory Warranty and my refusal to sign the AS IS papperwork, they come clean and admitted that there in fact was no Active Maserati factory warranty. Which in my belief and understanding also constituents UNFAIR OR DECEPTIVE ACTS OR PRACTICES under both Florida Law and the FTC.

They then offered to sell me an extended warranty (How convenient) and when I told them that I already bought the Active Maserati Factory Warranty that was advertised and that they needed to pay for the extended warranty, they offered to split the cost. I then ask if you are offering to split the wholesale cost or the retail cost, they said the wholesale cost. I said because you get about 50% commission on that, he confirmed wholesale cost...I said so you are saying that you will received no commission on the sale and you are paying half of the cost without commissions and he said yes. I asked are you willing to put that in writing and he said yes. I HAVE ASKED MULTIPLE TIMES FOR THAT AND I HAVE GOTTEN NO RESPONSE and i believe I was lied to and will be researching this further with the contract company.

the owner of Miami Auto Imports Serge Glazov states that all of this is nitpicking and that I bought it as is, but he said during the process that they stand behind their cars....as is does not mean that they can carry our deceptive trade practices and say the tires are nearly new when they nearly need to be replaced, they can not say that the car was only serviced at certified dealers unless they have material proof which they do not, they ave not advertised the car is under active Maserati factory warranty when it is not....and then say well you bought the car as is...

WE AUTO IMPORTS MIAMI CAME TO A MUTUAL AGREEMENT WITH THE BUYER AND ALL ISSUES AND COMPLAINTS HAVE NOW BEEN RESOLVED .  MR. RUSH HAS BEEN REIMBURSED FOR TIRES AND WARRANTY APPLIED TO VEHICLE.  THERE WAS A MUTUAL MISUNDERSTANDING WHICH HAS BEEN COMPLIED WITH .  MR.RUSH IS 100% SATISFIED AND HAS NO MORE ISSUES OR CONCERNS WITH AUTO IMPORTS MIAMI.

The owner and I discussed the issues that I had and we both heard each others' side and came to an amicable resolution. I appreciate the time and effort that Miami Auto Imports put forth in their service recovery efforts. I regret that I felt the need to post the orginal review and would remove it but the Report does not allow me to do so. Again we have resolved the dispute and conflict to mutual satisfaction.
