Thomas Atlas was hired to do a complete renovation of my house.  Instead, the house is now in worse condition than it was when he started.  My grievances with this contractor during the contracting period are detailed more below, but I will summarize:

1.  Consumption of Alcohol onsite during the workday

2.  Poor Quality Work 

3.  Expensive work that has to be redone because he did not hire licensed/qualified subcontractors for plumbing, foundations, or electrical

4.  Starting about a month into the renovation, he and his crew only appeared onsite once or twice a week - then disappeared for weeks at a time

5.  After I fired him, he filed a fraudulent lien on my house in the amount of $100,000.  The total contract amount was $86,000 and he had already signed lien waivers for $65,000.  So at a minimum, he lied about $79.000.  

6.  I am suing him to get the lien removed - but I have little hope of getting any damages out of him, which have been substantial.

7.  He even stated that he would file a lien on my house "so that no one else will work on it" 

 

Below is my letter to Thomas Atlas detailing the issues I had and offering him the opportunity to correct them.  He refused, and was terminated:

            Re:  Notice of Default of Contract and Opportunity to Cure

Dear Mr. Atlas,

This letter is to notify you that you are in default of contract and have the opportunity to cure the default and return to good standing according to the conditions outlined below.  You are not allowed onsite until the provisions of this notice are accepted in writing. 

You are receiving this notice of default for the following reasons:

  1.  Failure to perform quality work.
    1. Paint splotches on all walls
    2. Messy paint at borders in need of touch-up
    3. Floors, which were in excellent condition at the time of purchase of the home, were stripped, and are now coated in paint from the walls.  The floors will need to be re-sanded in order to finish.  This item is also under ‘Destruction of Property’
    4. Inconsistent wall texture throughout the house. 
    5. Use of both satin and matte paint on several walls.
    6. Tile in shower pan was poorly installed with crooked grout lines, inconsistent grout widths, and inadequate drainage. 
  2.  Failure to perform work in a timely manner. 
    1. Minimal progress has been made on the project since the previous draw on September 25, 2017.  Several items are at 30% completion or less, including all cabinetry work, doors, bathrooms, fixture installation, siding/soffits, and patio. 
    2. Contractor has since abandoned the project, last appearing on site on October 19, 2017.  Contractor refuses to return to project citing a pending change order. 
  3.  Destruction of property. 
    1. Front door was broken by General Contractor’s personnel.
    2. Wood floors were stripped and are now covered in paint. 
    3. Contractor’s trailer, which sat on the front lawn covered in garbage, killed 80% of the grass underneath it. 
    4. Owner’s personal items, including a chair and microwave, have been coated in paint. 
  4.  Failure to adequately communicate.
    1. Owner requested status updates from contractor in the form of texts and emails, to which the contractor made false claims about timing of certain items, particularly completion of the bathrooms and flooring. 
    2. Those false claims led to undue and burdensome inconvenience for the owner.  For example, contractor claimed the flooring would be completed the week of October 15, 2017.  Owner made plans to be out of town to accommodate the contractor’s work and indication from the contractor that the floors could not be walked on for 2 days after application of polyurethane coating.  Owner requested a status update on Saturday, October 21, to which Contractor replied that the floors would not be completed, or even started during that time. 
    3. Owner has repeatedly stayed in hotel rooms at great expense based on indications from the General Contractor that the home would not be habitable due to the work being done at that time.  Each time, the owner returned home to discover no work of the kind indicated by the contractor had been performed. 
  5.  Failure to address changes made by owner to accommodate contractor’s scheduling. 
    1. Due to Contractor’s failure to maintain an adequate schedule, the owner has made accommodations in order to convenience the Contractor and further progress on the project. 
    2. One such example is the reduction of wainscoting by 67%. 
    3. Another such example is Owner ordering most of the fixtures required for the bathroom and kitchen, and ordering the kitchen flooring and backsplash. 
    4. Contractor gave no verbal indication that any changes discussed on the project would be an extra expense.
    5. Owner attempted in good faith to reduce scope of certain items (wainscoting, kitchen sink, guest bathroom shower, master bathroom tub, combination washer/dryer) in order to speed up progress and reduce cost. 
    6. However, contractor has instead presented owner with a change order totaling over $8,000 for these items months after they had been discussed and agreed to. 
  6.  Failure to order materials in a timely manner or at all. 
    1. At the Contractor’s request, Owner put together an order at Moore Supply for the bathroom fixtures.  This order was sent to the contractor on July 27, 2017.  Contractor placed the order for the items on September 25, 2017.  Invoice was sent to Owner on October 16, 2017.  Contractor ordered the wrong materials.  Order of new materials would take another 30 days.  A change was made by the owner, in good faith, to instead use a drop-in acrylic bathtub which could be ordered and installed the same day in order to keep the project moving forward.  The owner sacrificed the original vision and design for the master bathroom in order to convenience the contractor and move the project along. 
  7.  Consumption of alcohol on premises. 
    1. Numerous beer cans and the remnants of 24-packs of beer have been seen all over the property.  On at least two occasions, owner has smelled a strong scent of alcohol coming from workers onsite. 
  8.  Rude and disrespectful behavior toward owner.   
    1. Contractor has repeatedly berated, insulted, and lied to the owner.  This behavior will not be detailed in this letter, but is readily available and documented in texts and emails.  

Upon adequate completion and inspection of the project by the owner, Contractor will in turn be paid 100% of retainage owed to him. 

Please sign below indicating you agree with the terms as outlined in this notice.  Failure to agree to these terms by October 26, 2017 at 5:00 PM CST will result in immediate termination of the contract.

 WE DID COMPLETE the HOME RENOVATION TO this OLD HOUSE AND DID NOT GET PAID.

As you can see NOW he is slandering us,                   

HE will do it to YOU as well   STAY AWAY FROM THIS PERSON and the property is a dangerous individual

HE DIDN't pay another person $5,000.00 dollars for their dervices.  STAY AWAY FROM HIM AND HIS PROPERTY

Not only he does not have the money to pay for the remodeling, Also the fund in escrow account are frozen and cannot be released until I get paid 

    You will waste your time with him and this job.

 we did a major renovation to the property, old house over 40 years old , with no HVAC, in very poor conditions that actually needed to be demolished , we remodel this house completely with new HVAC, add a additional bathroom, addition to the house , new siding, repair rotten woods, painting, tile work, demolishing and enlarging the master bedrooms, living room ,  removing windows to create openning and install French doors (2), foundation repairs, plumbing project from A to Z , wood working . we did it all

we start finishing the final interior with painting and detail work, we noticed that this individual hired an interior designer for the project and suddenly changes started that we never agreed on which we followed the original contract.  the interior finishing start to change to the new design, since this project was financed through FHA loan Any changes had to be approved by lender first. An example , Our contract noted that the house to be painted in two colors, at the end we painted the house in 5 colors and shade in different walls,  We purchased expensive material using our account to pass on the discount to him for the items which was not in the contract and required change order, an example , $13.00 dollars per sqft for designing marble floor, tiles $6.00 dollars for the walls tiles , $1,500.00 dollars for the claw foot tub that the actual cost was $2,200.00 dollars. After waiting for a month and delaying the job, when bathtub arrived, he decided he did not want it. $400.00 dollars for the sink actual price $680.00, and the list goes on for the items we purchased base on the discounted rate and he did not pay for them, we installed new door to the kitchen, pocket doors to the bathrooms. Attic access, new hot water heater, windows, demolishing the wall and enlarging the master bedroom ETC    we never got paid for any of them,

we credit him over $8,000.00 dollars for change order in the contract deleting some items that he did not wanted and we completed over $15,000.00 dollars additional work and price differences for the material cost that we were entitle to the change order, AND this individual blocked us to get paid for the materials that we spend and work that we have completed ,   since we worked with lender this project was a construction loan and already lien was field by the lender in the property record and partial of the fund that we received and lien was released  for the completed project was authorized and released by this individual. we got paid for the partial of the projects NOT the rest.

According to this loan if the homeowner was not satisfied with work? He had rights to stop the payment until disputed items was corrected and completed. 

He breached the contract because we would not DO any additional work until we get paid.

Kyle Ambler (((REDACTED))) Austin, TX 78721 now slandering us on line since the balance remaining of the original contract has been frozen and lender cannot release the fund. Until we get paid, we offered Kyle Ambler in many occasion with lender consent in settling the case for the fracture of the money owe to us HE REFUSED to do so. Prior to this his posting, we offered him again, HE refused and NOW slandering us on line with false information, when actually in fact he is in default.

Since this loan and project was funded by special government program lending which requires contractor to be assign prior to the closing, NOW we believe that Kyle Ambler intentionally used us in this loan program to own the house since he was not able to own it in the first place. And had no intention to renovate the house that’s why he made it difficult for us to work at the project and his sole intention was hoping that we leave the project abandon and the balance remaining of the contract would be credited to his principal loan which we did not. NOW he is stuck.

few months ago we received a call from interior designer that he hired , HE  did not paid this person $5,000.00 dollars for the services and designing the interior part of the house and had a payment plan scheduled for $500.00 dollars a month to pay back ,Kyle Ambler at (((REDACTED))) never paid this person and still money is owed.

 We been in Business for over 33+ years, completed over 20,000 projects, we have the same number for decades. We do more than what we agree on the contract in every project and please our customers AND 90% of our projects are referral NOW this individual    Kyle Ambler is being vindictive and posting false, misleading info, about us.

 To all the CONTRACTORS in Austin Area, please BEWARE of this person Kyle Ambler located at (((REDACTED))) Austin, TX 78721 and STAY AWAY from this project. Not only the fund from the lender is been frozen also he doesn’t have the fund to pay for the project and also to let you know that he is very manipulative. Deceptive person, every time he stopped at the jobsite we smell alcohol on his breath in the morning. Kyle Ambler is a dangerous individual that you do not want to deal with  you cannot make living with this person and this job just like us, lost money,  He would change his mind 10 time a day about projects and what need to be done.

Furthermore according to this loan guideline contractor had to invest his own money and complete some portions of the project before he get paid. So now we lost what we have invested.

  All the contractors are not bad people,   Kyle Ambler IS a BAD PERSON that you do not want to have any dealing with him.

I AM TAKING THIS person TO THE HIGHEST COURT OF LAW no matter what it takes, not only to get the money what is owe to us also he is liable for the damages with slandering and lie, misrepresent of facts on line for no reason,  

hoping that he will learn a lesson and doesn’t do it to another person what he done to us.    

Kyle Ambler,  you did us wrong, we gone extra miles to please you but you want everything for free, 

We will prove you wrong.
