Alyon Technologies billed my phone number for the amount of approx. $162.00. I was billed by my home phone number, a number

I have a 900 and 976 block on.

No adults in this home entered their website.

According to a person at the company someone here had made a conscience choice between entering or not entering the 'adult' content site.

How was a person able to do this I asked?

It appears you can get into the web site without proper adult identification and without any form of 'credit'. It is called a NOCREDIT website.

The Alyon bill states the invoice represents charges for 'Pay Per Use Internet Access to Prorietary Content as an Entertainment Fee made via a 900 or direct dial number dialed by a computer modem from this phone number'.

I have to infer that this company is deceptive and is targeting persons who do not have the means to pay. I believe one of the groups they are targeting are minors.

I have disputed the charges from Alyon Technologies.

I have had a 900 and 976 block on my phone line for years through Pacific Bell yet they were able to hijack my phone number and allow it to be used to get to their web services.

I was billed based on my phone number, through the internet. The person I spoke to at Alyon said someone here had to hit the specific prompt in order for them to get into the site.

Alyon blamed me because I did not have stricter settings on my computer.

This was an intentional act on the part of Alyon Technologies of Norcross, Georgia to change my phone carrier to a Guninea Bissau (+245) controlled number. It appears this was done by them installing a program into my computer allowing them to disconnect my internet carrier then dial to their number using a Trojan horse type Virus.

I want Alyon Technologies to drop all charges and be fined according to Federal Trade Commission laws and guidelines.

Alyon needs to be shut down.

This company defies ethical and moral standards by allowing children access to their adult materials.

On November 26, 2002 the FTC (1-877-382-4357 or http://www.ftc.gov) released to the public a decision about the same type of practice against Integretel, Inc. and eBillit, Inc for $1.8 million dollars.

Dear Gregory-

I have read your e-mail correspondence with Archbishop Myers and he asked for my input. I can see why you are so discouraged with Alyon Technologies in Secaucus. I feel like you, that even though adult content material is permissible by law, it is reprehensible that this website puts a self opening Trojan horse type virus into computers and allows anyone to view their objectionable material without proper identification.

Unfortunately, because it is not against the law, there is little we can do to stop this type of exploitation of our children. It is important, however, to continue to apply pressure to our legislators to pass legislation that will outlaw pornography on the web. In the meantime, I have asked our computer expert for some ideas on how you can avoid this problem in the future.

First, a program that will effectively stop the majority of pop-up ads, which it seems this originated from, is called STOP-POPS. It only works with MICROSOFT INTERNET EXPLORER not NETSCAPE or other web-browsers. This will stop most pop-up ads while surfing the web. Information on STOP POPS can be found at the following web site: http://www.stoppops.com/index.php.

In programs such as KAZAA, this probably will not work. Since Kazaa is a PROGRAM, content within can be sent by the PROGRAM PROVIDER. Therefore, I would not recommend unsupervised children use it. Any internet-connected computer needs anti-virus software installed and running. Additionally this software must be manually updated on a regular basis to ensure complete effectiveness. I highly recommend Symantec's NORTON ANTI-VIRUS, retail approximately $40. Information, as well as trial versions are available at: http//www.symantec.com/nav/nav9xnt . Internet security solutions can be a daunting subject for beginners. 1. Alyon did exactly the same thing as Integretel,Inc. installing a virus Mini-dialer (Computer Hacking).

2. Alyon may be a cover for an FBI operation

3. Alyon said the Internet was for adults only. That makes me suspect the Feds even more.

4. Alyon is using http://www.Kazaa.com to lure teenagers to look at provocative pictures.

5. Hitting a prompt saying you accept' could happen in the background when you are attempting to shut down pop-up adds.

6. This fits all the criteria to be terrorism.

7. Money is going to an overseas operation.

8. If Africa is used as the place where Alyon is dialing to then some of the money is funding (censored) in Africa.

9. The telephone long distance carrier AT&T is knowingly and purposefully allowing Alyon to do this because they are being paid for long distance fees and probably getting a kickback.

10. Children are being hurt emotionally and psychologically.

11. The Internet is not for adults only as Alyon suggested to someone.

12. Gwinnett County Georgia authorities have known about this criminal enterprise and may be involved on some level.

13. The United States government is endangering our children by allowing effortless access to adult material'.

14. The same person (Tina Whitfield) that is controller of USCI is also at the same address as Alyon.

15. The government lies to citizens and says no complaints have been made against Alyon when they go to the FTC to complain.
The government is supposed to help citizens not lie to them.

16. The FCC says this does not qualify as a slamming violation but if they read the words of their definition it fits exactly into that protocol. The FTC under the slamming law' found Inc Integretel, Inc and eBillit, guilty of exactly the same thing. What is wrong with this government?

17. Minors contractual capacity.

A contact made by a minor is voidable at the election of the minor!

The minor may affirm or ratify the contract upon attaining majority (reaches the age of 18)

Minor's misrepresentation of age. Generally the fact that the minor has misrepresented age does not affect the minor's power to void the contract. Section 14:3 Business Law Principles Cases Legal Enviroment 1989

18. Ordinally a parent is not liable on a contract made by a minor child.
Section 14:9 (a) Business Law Principles Cases Legal Enviroment 1989

The parent may be liable however if the child is acting as the agent of the parent in making the contract. Let me fill you in on what that means.
If you as a parent said it is okay to act in your behalf, then you could be held liable.
Parents are liable for the necessities (food, shelter, clothing) of a minor.

However, if the parent is unaware that the contract is made between the minor and a company, the minor and the parents can not be held responsible.

19. A minor can avoid contracts, which means that the minor cannot be required to pay the purchase price or perform any obligations of contracts. However, exceptions have been made and a minor may no longer avoid certain types of contracts. Examples include contracts of insurance, stock purchase, or contracts made by a minor running a business.


20. Alyon is trying to bill the owner of the phone number in order to avoid the issue with minor involvement.

But, if an adult entered no contract, in spite of what Alyon is telling you, ALYON IS BREAKING THE LAW!

21. Alyon is a sleazy, (censored), unethical, rude, un-American, lowlife (censored). If the authorities are involved then they are all of what Alyon is.

22. Stonewalling-Fatcat bureaucrats in Congress have still not passed 'Protect Children From E-Mail s**t Act of 2001 (H.R. 2472)!

23. Contractual capacity is the ability to understand that a contract is being made and to understand it's general nature.

If anyone hits the Accept button that Alyon describes allows all of this to happen without knowing what he or she was doing , then he or she did not have Contractual capacity.

The fact that a person does not understand the full legal meaning of a contract does not mean that contractual capacity is lacking. Some person, such as minors are deemed by the law to lack contractual capacity. Section 14:1 Business Law Principles Cases Legal Enviroment 1989

A MINOR CAN NOT ENTER INTO A BINDING CONTRACT!

I received your letter and I have been notified before by someone else having this same problem. I have been to the location of the office of what is called Alyon Tech. listed as 3100 Medlock Bridge Rd. suite 1400 and it is in fact located outside of the City of Norcross. Also on the front door it has some other business name on the door. There is not now nor has ever been a business license issued in Norcross under this name. I will help in any way I can to help you, let me know.

Posting LINKS

Many times links to unknown web sites will cause your pc to freeze up and /or cause you to get a computer virus, virtually rendering your computer useless. Most of the time, this is the work of a Company or an Individual who has been reported.

Many Government links are no better than the BBB and are just a waste of time, giving you false hope. Many government sites (like the BBB) just collect all information from you, the consumer, but never make that information available, so consumers will NOT be educated as to what exactly they should be looking out for. On the other hand, many government agencies have and do come to the Rip-off Report for information. We have been assisting many government agencies for some time now, including the FBI and Attorney General offices from around the country..

Now that all these Rip-off Reports are out in the open for everyone to see, in a way, this embarrasses these agencies into doing something when they see so many reports on a Company or Individual, because they are now out in the open for all to see. Unfortunately, many (not all) Attorney General Office's and government agencies will not move against a rip-off unless there is going to be some sort of publicity on the rip-off. By reporting your experience on the Rip-off Report, is the next best thing to getting your story on TV or in a newspaper. Most national TV networks and many local TV stations from all around the country come to the Rip-off Report for information they will not get from the BBB, Attorney General office's or any other government agency. Rip-off Report has instigated many local and national stories, resulting in help for victims, in one way or another. Most government agencies will never even bother with rip-offs unless it involves $50,000 or more. Now that the government is cutting back even more dollars for these types of programs, this number will even get higher and we can expect even less to get done, by even less people to work on all these rip-offs.

LAWYERS :

We have also struggled with the following for a long time..

The reason why we delete phone numbers, ..all too often unscrupulous lawyers or individuals posing as lawyers are collecting victims information to only further victimize them. Many times, well-meaning consumers think they are going to collect names and get them to a lawyer who will do something. In every case we have allowed a consumer victim to do this, nothing has ever came of it. Consumers were under the impression that something will be done to get them help. In every case this did nothing but lead the consumer on, further victimizing them, and some consumers were mad at us. We feel it is our responsibility to check the legitimacy of the lawyer before advertising their service on the Rip-off Report.

We will also not allow lawyers to use this web site for free when they will end up taking a large amount of fees, leaving the victim with very little. There are many competent lawyers out there that know how to get the unscrupulous Companies or Individuals who ripped you off, to pay their fees. Those lawyers capable of this can post their numbers after checking with us here at the Rip-off Report.

POSTING YOUR E-MAIL ADDRESS:

For similar reasons as mentioned above, we will not allow individuals to post e-mail addresses, so they can be contacted for more info they claim they cannot post. If that person can contact YOU and get the information, so will everyone else be contacting you anyway, and, if it's good enough for them to receive it by contacting you, then you should be able to post that information for everyone to see and know about. And, many times, in an attempt to get your contact information, consumers will leave an email address; this is just a ploy to sell you a product or some other service. Most likely, you will end up on other junk mail lists. ..if they have something to sell, they should place an advertisement showing support to Rip-off Report.com so we can further help consumers.

I need to let you know that a company called Alyon Technologies located in Norcross, Georgia is causing me a problem.

They are attempting to bill me for $161.37 for use of their site. No adult at my home used their website.
It is an adult website.

I have tried the BBB of Atlanta, FTC, Attorney General of Georgia, Attorney General of California, the IFCC, and several other agencies. I e-mailed your local newspaper yesterday.

I need your help to get my bill cancelled. Alyon Technologies http://www.alyon.net has also made the news at http://www.ripoffreport.com .

I think you should go there and read the complaints.

I don't plan let this go until Alyon Technologies stops getting away with this criminal activity.
