His aunt, my husband's cousin passed away in 1997 in South Bend (St. Joseph County) Indiana. He and my husband were both named co-executors of her $500,000.00 estate. We were living out of state (Rhode Island) at the time and Mr. Kertis informed us that the state of Indiana required we post a substantial bond in order for my husband to be co-executor. This, we now know was a lie and I believe it was his intend to steal the estate monies from the beginning.

After 3 years of excuse making and dragging his feet we finally were successful in setting a date for a hearing to finalize the estate in probate court. At that time we discovered what we had suspected to be true was indeed true. There was no money left in the estate he had mismanged the state and stole $290,000.00 for his personal use. He appeared before Judge Nemeth and the judge ordered he be sent to the county jail for comtempt of court. He spent 7 days in the county jail and was released to raise money to pay the heirs. He managed to come up with a mere $40,000.00. Many months ago he was ordered by the court to pay the estate $1,000.00 a month, the estate has not seen one red cent of this court order. He is in contempt of court again.

He still practices law in Indianapolis. The Indiana Supreme Court Disciplinary Comission tells us that it will be another year or so before he can be disbared. We contacted them about 9 months before the hearing date. They apparently have a heavy case load and cannot get around to dealing with this case.

I have shortened the details of this case because of time and space.

This commission is good at ducking the issues, refusing to even develop a cursory investigation into the complaints of consumers who have been ripped off by Indiana licensed attorneys. I have a problem with an Indiana attorney and filed a substantial complaint with the commission. My complaint was well documented with transcripts, court orders and corroborating information (against Don Tabbert and Tabbert, Hahn, Earnest and Weddle law firm). The disciplinary commission decided no investigation was necessary five days after receipt of my complaint! I think the commission is politically motivated in some instances. They didn't even bother to contact the attorney! I wrote them describing my disappointment in their decision and requested an appeal or rehearing. I sent copies to the media and Governor Kernan, asking him to review the actions of the Disciplinary Commission. It has only been a week and I've not received any response from the commission or the Governor's office. Good luck getting this bottom feeder to pay up. Our attorney got us for $45,000! and did nothing for it. Can't even get a proper accounting of what the money was used for, etc. We are currently picketing the firm in an effort to pressure them into returning our unused funds.
