I had excellent credit history with no negative reports ever until recently when a now defunct LLC I previosuly owned settled a business credit card account with Advanta Bank. Through my attorney we contacted Advanta to inform them the business had failed and we wanted to settle the account. After no written response to acknowledge our offer to settle, we sent a followup with a check as an offer if they should accept. Advanta accepted the settlement check and continued to bill the account. They later wrote me personally that they intended to hurt my personal credit profile. Well, they did. They reported the account as deliquent 3 months after they accepted our settlement check. Needless to say my personal credit score dropped from excellent to fair and by over 150 points. Other perfectly paid business accounts (American Express) reduced their credit lines to the balance due on the accounts because of the action by Advanta. They have continued to call and harass and refuse to deal with my attorney.

I have seen Advanta do this to 2 other small business owners. They refused to pay the 37.5% interest rate Advanta jacked them up to. Advanta in most all cases never reports any credit card information to the 3 personal credit bureaus, even though they can, because they claim to be a small business credit card. Yet, they typically use your SSN and personal FICO to open an account. They have started adding negative information to people's credit reports such as yourself and these 2 others, trying to ruin your credit and force you to pay their predatory high interest rates. I would get with your attorney and have sue them in small claims court if available in Alabama. They already have lost one small claims court suit by Scott Feldman in Doylestown, PA filed in Philadelphia court. There are hundreds of complaints here on Ripoffreport that can give your attorney all the ammo he needs, such as noone receiving opt out reports, etc.
