During the month of October 2002, ADS Corporation set up shop in Kingston, NY to hire individuals for delivery of TransWestern phone books. ADS agreed to pay employees for phone book deliveries within 3 to 4 weeks of the completed route. I completed 5 routes. For each route, I had to call ADS Corporation on a daily basis to obtain status on my check. Each check was delayed and ADS insisted that each one of them was mailed but they must've gotten lost in the mail.

I cashed the last check I received but was contacted by the insitution where the check was cashed that ADS had put a stop payment on the check. I had to reimburse the instituion $140 for the face value of the check plus a $25 bounced check fee. At no time did ADS ever inform me of a stop payment nor did they attempt to rectify the situation by mailing me a new check.

In summary, I delivered phone books for ADS and TransWestern and had to pay out of my own pocket $165.

ADS did not respond to any letters mailed to them. As a result,

I filed a complaint with the Better Business Bureau of IN and the State Consumer Protection Board both of which closed their files since ADS never responded. I filed a complaint with the Attorney Generals office on 3/5/03 and I still have not received an acknowledgement from them.

I contacted the Town Hall in the area in which I worked and was told that since the company is not based in the area in which I was hired that I would need to file small claims in the state in which the company is actually based. I would have to fly to IN from NY to file the small claims action and then return again at the time of the hearing.

I have now notified TransWesterns legal department.

I have considered contacting the media myself but would be more than happy to volunteer any information and assistance to the media and/or consumer advocate. It is unfair to present a job opportunity to an individual and then fail to pay for services. The frustrating part of this situation is that I had to lay money out of my pocket and the state agencies that are supposed to assist consumers do absolutely nothing.

TransWestern will be looking to deliver phone books again in the Fall of 2003. People throughout the US need to be forwarned to confirm who the vendor is that is paying the wages. If it is ADS, do not take the risk. TransWestern has not backed up their vendor and it will take you months to recover any money for services provided to both ADS and TransWestern.
