Addie, Send the CEASE Communication letter as per your rights under the FDCPA. Be sure to put the certified# on the letter itself, and keep a copy for your records. Now you will have evidence for when they offend again. STAY OFF THE PHONE!! There is NEVER any reason to speak with ANY debt collector on the phone. It will NEVER do anything positive for you, and will almost always make things worse. Keep in mind that paying that collection account actually hurts your credit more than just letting it go. Paying it will not remove the negative from your credit report, it will just be marked as a paid collection, but now will be a more recent negative, which hurts your score more. Any act of retalliation or threats made by a collector are illegal, and you have civil recourse. You should file a lawsuit immediately. FYI. There is no such thing as "refusal to pay" that can be put on your credit. They probably don't even have your SS# or access to your credit, as if they did, they would see the account is already in collections with another agency. Forget about class action lawsuits. they are a total waste of time and money and the only winners are the lawyers. Take action on your own and hold them accountable, and get paid!
