This company has some of the rudest lowlife I have ever encountered. They are hounding my Mother several times daily and outright REFUSING to honor the Cease Communications Requests that she has made.

They told her that they can call as many times a day as they want and there is nothing that can be done about it! They laugh at the FDCPA.

They refuse to give a name or address when asked. I had to research them on the internet, and verified against the toll free # they left on the machine.

They are attempting to collect a debt that has been long charged off. They know my Mother is disabled and on fixed income and below poverty level. They know she could not pay if she wanted to!

Time for an FTC complaint and a Certified/RRR Cease Communications request.

Thanks for the reply. Yes, I have done all of those things already. I just post here to slam and embarrass the scumbags. I got thier fax #'s and saturated them with several hundred faxes until toner and paper ran out. That is one of many sources of entertainment that I participate in. I just represented myself in a lawsuit that Love, Beal & Nixon filed against me and got it DISMISSED before ever going to trial. They screwed themselves. Arrogance and stupidity is a very bad combination. They violated proper proceedure and I called them on it. Filed a motion to dismiss with the court, and also did a bar asociation complaint for illegal and unethical practices. Also filed an FTC complaint. I go for overkill to completely destroy the life of anyone who challenges me in any way. It's just a personality flaw I have. :)

In addition to my prior reply, even if every customer paid every payment on time and every balance in full we would still pay the same interest rates. This is because of the greed factor of these big companies. The executives could not get multi million dollar bonuses and fly around in Lear Jets without huge fees and high interest rates. There is a percentage of debt that they have already figured in as being bad. It is a cost of doing business. If they are under that amount, that just means more profit. If these banks really were concerned about losing money, they would practice responsible lending instead of predatory lending. In all of the years I had spotless credit, I never once had a bank re verify my creditworthiness! I was getting credit cards mailed to me while I was injured and unemployed for 8 months with starting credit limits over 10k! These greedy and irresponsible companies get exactly what they deserve. So put your crack pipe away, go back and pass the 6th grade, and get a grip on reality. ps. I used to work in the financial industry, and I can tell you that you have absolutely no idea of what you speak of.

John, Before you throw in your two cents, know what you are talking about and also learn how to spell and form a proper sentence. First of all, the things that they are doing are in violation of several laws. I am staying with my mother providing her assistance and do have full authority from her do handle all of her affairs. The first violation of federal law, is "causing a telephone to ring in an attempy to annoy or harass", a clear violation quoted directly from the FDCPA. The second violation is refusing the cease communications request. The third violation is not providing name and contact information upon request. The fourth violation [of nature] is just being a lowlife scumbag bottom feeding debt collector. It sounds like you are a debt collector or have been one. Most people who can't spell or form a proper sentence take those type of idiot jobs.

The laws that the original poster refer to are in place for a reason. The original poster needs to find out if this debt is actually her Mother's debt and if it still within the statute of limitations in her state. Refusal to honor a C&D is illegal. Did you send it Certified Mail, Return Receipt Requested? If so, your Mother needs to contact the FTC and her Attorney General's office and report this behavior. If all else fails, file suit against the collection agency. It would be in your Mother's best interest to get a tape recorder for her phone, and when the collection agency calls back, tell them that she is recording the conversation and that they are in violation of her C&D. Go Get 'Em!

its not a crime to attempt to collect on a legitimate debt. the fact that its been charged off means nothing other than the debtor was irrisponsible or unfortunate enough as to where a creditor wanted nothing else to do with them and took it as a loss for the time...believe it or not we all pay for these people who dont pay their creditors, on average each american pays 6,000.00 more a year on retail goods because stores and companies need to protect their butts from people who think its ok to just not pay. overall your taking 6,000.00 out of a hungry persons mouth or you could say contributing to the poverty of this country. when a company writes it off they get a tax break and the rest of us paid those taxes. sure not everyone is perfect everyone makes mistakes but we all need to own up to them at some point. if you dont hold power of attorney then collectors wont tell you who they are. would you like it if you owed money and somone answered your phone and found out you do? thats what the fdcpa is! for your protection!your crying about when people dont follow it but mad when they do. if you really want the calls to stop then handle the situation in the proper manner.
