Last January 2001, my 82 year old husband and I (57) purchased a used mobile home from ABC Homes in Picayune, Mississippi. In the process of traveling from Arizona, with a travel trailer, we were in an accident and received a small settlement. We used this money to purchase a piece of property and for living expenses.

Due to a bankruptcy and a home forclosure in another state, our credit was ruined. We had looked everywhere for a home to buy but could not get financed. The last place we looked was at ABC Homes, where we met Marty, who agreed to look for a home and said they would hold the papers on the home, till the home was paid for. She had used homes on the lot, but every thing we liked she would not sell to us. She called me, at my friends home, where we were staying, stating that she had a home that was traded in, that she would sell to us. She said the home was in Pearl River, gave us directions and we drove out to see the home. It was obvious that it needed work, but due to the fact that it was waiting to be moved off the property there was no utilities, and no lights to really see by.

To make a long story short we bought the home, put down $1500 and signed the papers to pay $8000 for this home. The home was delivered to our property on January 31st. Then we discovered that there was no heat system and no refrigerator, the tub was busted in the center and the tolit did not work. I had told her that a window was broken and there was a piece of ply wood over an opening in the side of the trailer where an addition had been removed. She had agreed to repair this and a wall that had been partially removed.

When she found out that she had to replace the heating unit she raised the price of the home from $8000 to $9800 with 12% interest for 4 years.

We lived in this home in the bitter cold of winter, it was 30 degrees inside the trailer, for a month before the heat was fixed and when the electrician said he needed another wire to connect the heat unit Marty refused to pay for it. I called her and she said "you bought the home AS IS and I told her that there was no place in my contract that said as is and she told him to fix it.

It was March 5 th before we had a tub to bathe in and a tolite that worked. The real kick in the pants is now we have roof leaks that the insurance will not cover. They said she should have fixed the roof before she sold us the home. Then I am told, by the Foremost Insurance Adjuster, that our home is worth a total value of $2500.

Next I get a letter stating that if the roof is not replaced or repaired with in 30 days that they will cancel my policy. I called Marty and she told me that she could have it fixed but I would have to pay for it, which I have no money to fix it. She then told me that she is waiting for the day that I miss a payment and she will come out and take the trailer.

I have never been late with a payment and have never missed a payment. I called a lawyer, in fact I called several lawyers and they told me that there is nothing I can do legally that it is an ethical issue but it is not illegal for her to rip us off in grand style.

This gives new meaning to BUYER BEWARE. There has to be some legal recourse. I thought ripping off the elderly was a crime? ABC HOMES IN PICAYUNE IS A MEGA RIP OFF THEY CHARGED US OVER $11000 FOR A USED MOBILE HOME WITH A TOTAL VALUE OF $2500. IF THIS IS NOT CRIMINAL THEN I DO NOT KNOW WHAT IS.

TRUTH ABOUT THE HOT WATER HEATER

In the rebuttal letter from Marty, of ABC Homes, she stated that we wanted a new hot water heater because the old one was not large enought. The size of the water heater was never an issue.
The reason we requested a new hot water heater was because the old one WAS RUSTED OUT AT THE BOTTOM AND DID NOT WORK.

Her worker, Mr. Chris Whitfield, flushed the water heater and filled it several times but the heating element was worn out and the bottom of the water heater was rusted all around the bottom and the bottom was falling apart.

Another point I wish to make is: Marty stated that she could not get us financed, for a newer home but she managed to finance us, through her company for the home she sold us. She had wanted to sell us a big double wide home, using our land as collateral for the newer home. I refused to put up the land because if I had gotten into a position that I could not pay for the home, I would have lost my home and my land and that is not fair.

All we wanted was a descent home, that we were willing to pay for and all she wanted was to pawn off and old trade in, for a ridiculous amount of money. On the contract she wrote up, there was not one word that said we purchased the home AS IS AND WITH NO WARRANTY. When I ask her to make repairs she got irate and threatened to take the trailer. Yes, I did file a chapter 7 bankruptcy and could have paid her, separately for the home, but by paying her this way she could still take my home on a whim.

By including her in the bankruptcy proceedings, i only have to pay 12 percent of the $2500 that the home is worth (we had already paid $3700 on the home before we filed, and she can not touch the home. Bankruptcy is a blight on your credit and a humbling experience. Ihave learned to live according to my means and not have credit cards of any kind, buy necessities not wants. Don't put yourself in a position to get taken by unscrupulous credit card companies, banks and most of all home sellers. If you find yourself entangled with a dealer like ABC Homes and there is no other way out, because they refuse to work with you, file bankruptcy that will keep them at bay. Yes, I did send her a Christmas card but she didn't understand the meaning of the card. The wording on the card (to my best recollection was) May the joy of the Christmas season remain with you through out the new year. We had already filed the bankruptcy, but she had not been notified as yet. I do believe that what goes around comes around and it was fixing to come around to her. I wanted her to experience the same joy she had given me or should I say the same heartache and aggrivation she had put us through.

I do believe she is going out of business, as the place where the business is located is almost desolate and there are for sale signs all around the property. She has only been in business for 2 years and I have met sever other people she has ripped off the same way she did us. Word of mouth, can make or break your business. When I met Marty, I truly believed she was a good hearted person but all that changed after she sold us a 28 year old dump instead of putting us in a 10 year old home that was in better condition. I wasn't looking for the TajMahal just a nice place to live.

BUYER BEWARE IS GIVEN NEW MEANING AT ABC HOMES IN PICAYUNE, MISSISSIPPI.

Let me state, my husband and I were the ones ripped off, not ABC Homes. Marty's statements in her rebuttal are not true. Here are the correct facts.
1- My husband and I were staying with my friend, of many years, and were welcome to stay for as long as it took to get into a home of our own.

2- We never sued any company or person. We were in an accident, in Sely, Texas on November 5,2000. The driver, of a d**k Simon Truck fell asleep at the wheel and ran over the travel trailer we were pulling. We were paid for our losses by d**k Simon Trucking, there was no reason for us to sue them as their insurance covered our losses.

3- The part about the electrical is an out and out lie. We paid for the power poll, electrical box and wires running to the home. When the air conditioning and heating unit was connected, by her workers, they hooked it up wrong. Marty called Edwin's Electrical in Picayune to fix it. Mr Edwin needed to replace a wire, that her men had installed that was not the correct wire and would have been a fire hazard if connected. Marty refused to pay for this and Mr Edwin told me he could not complete the work. I spoke with Marty and after our conversation she agreed for him to complete the job at her expense.

4- The drain in the bathtub was not messed up, as Marty states, but the bottom of the tub was busted out and covered with duct tape. It was dark inside the home, when we went to look at it and did not see this till we had the home on our lot. Also the tolite had to be replaced as it did not work.

5- As for the roof leak and the time elapsed. It has to rain for you to know if you have a leak or not. In this case a few sprinkles do not make a leak but after a heavy down pour the leaks were evident.

6- Yes, the home is 28 years old and Marty knew this however her company financed us for this home. I wanted a nice home, from her lot but she refused to finance us a descent home. All she wanted was to pawn off this old home, that in her own words "she never laid eyes on" to us. If she was so caring and wanted to help us she would have financed us in a newer home.

7- Every time I called and voiced a concern, Marty threatened to pull the home off our property. Mind you we were never late with a payment and never missed a payment but she threatened us with seisure of the home.

In summation:
I feel and am trying to get a petition, nationwide for a lemon law for mobile homes, like they have for autos. This would stop unscrupulous sellers, like ABC Homes of Picayune, Mississippi from doing to other's what they did to us. Since we purchased this home, I have met six other couples that she has done the same thing to. My neighbor is one of them.

I have noticed, that her place of business looks deserted and she is eighter moving to another location or going out of business. I hope she goes out of business as no one deserves to be treated the way we, and many other's have been treated by ABC Homes. What goes around comes around and the Man upstairs sees all, hears all, knows all and will deal with the liars and cheaters of this world. In life you reap what you sow.

in addition to the comments I made on 3-6-2002, I would like to add that the home in question was a
1974 model Used home (now28 yrs old) how in the world could anyone warranty or guarantee a home
that old. However, we attempted to help Mr & Mrs
Reilly and even after they filed the bankruptcy
in December 2001, they sent us a Christmas card,to my surprise. These folks were not taken advantage of, but make a bad name for people who
truly need help and appreciate your efforts in
their behalf.

In December Doris Reilly and her friend came to my sales center. She told me her tale of woe, they had been in an accident (which their whole life was in a pick up) and lost everything.

I attempted to get them into a home on our lot but due to their bankruptcy in 1998 it was impossible for us to secure financing on their behalf.

I sent her to other lots which dealt more in repos than we did at that time. No one would finance them.

o make along story whort I truly felt sorry for them as they were wearing out their welcome at a friends home and might be subject to living in their auto.

I told her to look at a trade in in another location(I never put my eyes on this home) She came back and told me she wanted their home and she even took pictures of items she wanted corrected in the home.

We made a list of these items to be corrected and both agreed to them. We wrote a purchase agreement at that time and agreed to finance her within our own company.

After delivery of home (which did not include utility hookups)she called and said she did not have the money to pay the electrician
for electrical hookup, we paid for this. Then she
found the drain in the bathtub was messed up and wanted a new tub, she found the faucets to be
corroded and wanted them replaced, she wanted a new hot water heater, the other one was not big enough.

We did all of the above even though we did not have it in our original purchase agreement. Mainly because I knew these people did not have the money and were in trouble. I found out later that they sued the company that they had the accident with to purchase their land.

Then after 9 months of living in the home she called me and said they had developed a roof leak
and the insurance company had told her it should have been fixed before they bought the home. It was not leaking at the time the home was sold, and
did not leak until 9 months after them living in the home. A used home is sold with no warranty and no guarantees.

She became irate with me and contacted the world to complain. Now she had filed bankruptcy again
and as I said before NO GOOD DEED GOES UNPUNISHED
iT ONLY HAS PROVEN TO ME THAT SOME PEOPLE YOU CANNOT BE GOOD TO. THEY WILL STILL BITE YOU IN THE REAR.

I AM SORRY TO SAY THAT SHE HAS RUINED MY ABILITY
TO EVER AGAIN HELP SOMEONE IN TROUBLE AND DIRE NEED.


BBB NO HELP WITH ABC HOMES, PICAYUNE PROBLEM

I filed a report, against ABC HOMES, IN PICAYUNE, MISSISSIPPI, but it did absolutely no good. ABC HOMES is a member of the Better Business Bureau. Their response to our complaint was, we regret that our efforts have not brought this matter to an agreeable conclusion but the matter will be retained in their file for three years. whoope doesn't suprise me one bit as I have never known them to resolve any ones problem, but I could be wrong about that since they can't force some one to do the right thing. ABC Homes sent them a bogus list of charges, for what they did fix in my home.

Marlene, Marshall, co owner and secretary, who by the way can't spell and can't add, told them she paid $450 for a tub that cost $85 and that she paid $425 to remove the old tub and $335 to install the new tub. It goes on and on but back to the real problem, the roof.

I have had several roofers look at the roof (including the insurance adjuster from Foremost Insurance) and they have all said that the roof is in no condition to hold a repair job. The roof has been patched many times and has breaks in it, from front to back and is rusted out in many places. I am told that I need a new roof and the best thing is a roof over.

Abc Homes refuses to put a new roof on, we have no money to pay for a roof, or we would as it is desperately needed. This is the company FROM HELL, AND ANY ONE THAT BUYS FROM THEM IS A FOOL.

ALSO, THEY HAVE RIPPED OFF MY NEIGHBOR, MR LORD, WHO PURCHASED A REPO FROM THEM AND THEY NEVER RETURNED TO LEVEL HIS HOME. THEY TOOK OFF THE WHEELS BUT LEFT THE AXELS TO RUST AND ROT, WHICH WILL CAUSE THE HOME TO SINK DEEPER INTO THE GROUND AS THEY ROT AND DISCENDEGRATE. THIS IS THE KIND OF BUSINESS THEY DO.

I WENT TO THEIR WEB SIGHT AND WHAT A JOKE. IT STATES THAT THEY ARE HONEST, FAIR AND ETHICAL AND THIS IS THE BIGGEST LIE YET. THESE PEOPLE NEED TO BE RUN OUT OF BUSINESS.
