In September of 2006 I received a notice that I owed $58.34 for some merchandise purchased by unknown person or company. I tried to contact ABC Distributing via phone, but was met with recorded message telling me their collections department was closed and stating the hours. Also, that if there was a dispute regarding charges to me that I needed to submit them in writing either to the address at the top of my mailing or via fax and then gave the fax number. I work during the hours they are open and could not make any contact via phone.

In frustration I wrote my dispute on the notices sent to me from ABC and faxed them. I was contacted the following evening (past the time that they say the collection department is closed)from an individual (I believe it's Tiesha)requesting payment on this past due amount. I try to explain my situation to this person...that I do not have the merchandise they claim I purchased, no delivery or refusal thereof of this merchandise has ever come to my home. I don't know how they got my physical address or have an account in my name. The only time I have ever purchased merchandise from ABC is when I worked for my former employer and it was never sent to my address. This charge was made in June of 2006 - I haven't worked for my former employer since April of 2005!

This is not my debt and I don't know what to do. ABC absolutely refuses to discuss the issue and says it is up to me to prove I didn't purchase these items. The phone call I received this evening 11/28/06 @ 7:00 P

ST was more of the same and I asked to speak to a supervisor and got the same refusal to resolve this issue...then they just hang up on you knowing that you can't call back because you will get the message that says the collection department is closed. Why give you an option to fax a written dispute if it won't do any good.

I would really love to have some legal advice, but who can afford it. This seems so stupid for $58 dollars.
