I had an account at Commerica Bank that I did not use often. On November 18th 2019,I had a fraudulent charge by two companies. The companies refunded me due to theses Fradulent transactions. I received $389.00 worth of overdraft fees.

I was told by Frank Gormley, that he would refund me all the overdraft fees, I also recorded him saying this on my phone and will take legal action. As a business you are required by Michigan law to honor what you say. I did not receive credit.

I went into the banking center a few times to resolve this issue. The assistant Manger Angela who looks like a smelly dog racial profiled me and was hollering across the banking center at me very rude and unprofessionally saying she was not going to refund me and Frank the man thaw told me he would refund me avoided me and would not even look at me.

This bank is racist and racially profiled me. Don't do business here. I will not back down and will continue to fight for the money I am owed. It's Embezzling and I have been sent threatening letters that I would be put on check systems for check Fraud.

This bank is the Fraudulent, Unprofessional, racist, liars. Don't do business here. This is the most disgusting bank I came across. Try Michigan First Credit Union and Bank of America for business accounts they are professional and  care about the needs and growth of the customers..Run from Commerica

- That is an incorrect statement.  You do not incur close to $400 in overdraft fees on an account that isn't used that often.

I will not back down and will continue to fight for the money I am owed.

- You are correct, you are owed money.  You are owed money from the company that fraudulently withdrew the funds from your account because they are the ones that caused the overdraft.  The bank followed their policy in charging those overdraft fees and is under no obligation to refund them due to the error of another company. 

In the past banks were more willing to reverse fees in situations similar to this.  But that is becoming a rare case with any bank, and even more rare when you obviously are acting irrationally in trying to get them to give you the fees back.

I also recorded him saying this on my phone and will take legal action. As a business you are required by Michigan law to honor what you say.

- Not all verbal statements would be considered enforceable, it depends on the circumstances.   The judge will take into account the entire situation to determine if that statement is reasonable, equitable, and made in good faith.  To counter this you can expect them to present the written terms and conditions of the account you agreed to that states under which circumstances OD fees are allowed to be assessed.  A written contract/agreement will override a verbal one even if the verbal statement was made at a later time.   The judge will also look at your credibility to determine what may have led up to that statement in the full context.

As at the same time you present your recording, they will present this report where you say one of their employees look like a "smelly dog".  They will show your report where you accuse them of "racially profiling" you with zero evidence.  This will reduce the credibility of the recording because the judge won't have the entire context of what led up to that statement.
