Complaint Review: Citi Financial Aka Associates Aka First Family

Over the years we had several mortgages starting with First Family each refinancing the last. We also owned two pieces of property that were near each other. In 2001, we had unfortunate financial difficulties and was unable to pay our note.

e offered a deed in lieu of forclosure to, by then, Citifinancial and they accepted our offer. However, a few months later we received notice of foreclosure. We checked the description of the property they intended to foreclose and it was the incorrect property- property we had never intended to mortgage and had never given them a description. We had to seek legal council to get them to stop the foreclosure proceedings.

A little later on we received another foreclosure notice and this time it was on the correct property, however, this note and mortgage had already been refinanced by the mortgage they started foreclosure proceedings the first time.

We again sought the aid of an attorney, however to no avail; Citifinancial did indeed foreclose. They satisfied the recorded mortgages on the property they foreclosed but failed to cancel the mortgages they recorded by error when the loans were made. We called trying to get the mortgages cancelled but we're talking on deaf ears. Any ideas? Thanks.
