I quit Sears on August 23rd 2009. I finally got my last paycheck (paper paycheck, NOT direct deposit) on Sep. 4th. 2009. I went and I cashed it as I normally do. Now, today is September 30, 2009, and I received a call from a guy who runs the gas station where I cash my paychecks. He says "Michael, we have a problem. Your company placed a stop payment on this check and now I need the $159.18 before I pursue further action." He gave me an extension until this Friday (two days as today is wednesday).



So, I called 1-888-88SEARS and asked them what is going on. They said my HR Manager put in a stop payment request, claiming that my paycheck was too high and did not reflect the hours and commission worked. CAN THEY DO THAT???? So now my problem. Commission.



There is no way to check the accuracy of my pay, because half the time you have no clue what the job pays. There is a flash report screen, but in my 9 months there, not one time, did that flash report ever match my earnings, so I know that was not accurate. So now my other problem. I called 88SEARS and they told me it was my responsibility to cover the check that THEY (Sears) wrote me. So now im pretty well screwed.



Again, the check amount was $159.18 and I'm expected to pay that. Sears has already admitted to me that it was HR and NOT me that requested the stop payment. So my next question. If that check did not in fact reflect my hours worked, WHERE IS THE CHECK THAT DOES???? I have not seen it. Nor has Sears given me ANY ANY ANY notification at all whatsoever. And NO, I did not sign anything authorizing any deductions. And yes, my uniforms are turned in even though Sears has already claimed it was a "too much pay" issue.



I am trying to work with a lady at corporate. Her name is Nancy Kerlyn. And Sears Corporate phone number as I was told by 88SEARS is: 847-286-2500. This is the worst thing I think a national corporate business could do to their employees, especially ones that left on good terms and not the ones that were fired or hauled off to jail!!(happens a lot in Danville I've come to notice) Any suggestions, by all means, email me.
