Prespa Auto Sales is selling defective cars and in their website they have a policy of return the car if you are not happy withing 24hrs with No question asked.

I bought the car on Thursday, November 12, 2015, at 8' clock nite in Tampa, Florida. I drove 2 hrs back to Orlando where I live, during the way back home I noticed a tremble in the car and thought was something with the RPM revolutions. In the early morning the car never starts again, then I called the dealership and the owner told me to check the battery or to bring it to AutoZone, and he will take care of anything wrong. I did that, but the battery was good. 

Because I was so disappointed, I just call him back asking for the refund policy and that I want to return the car for a total refund. Immediately, everything change and he said NO. After that, they never responded, either the salesman which messaged me back to stop texting him. I sent two emails to the owner yesterday 11/13/15 before the 24 hrs ended. However, they were gaining time. The owner responded me today after 4 pm because I place a claim against them in the Florida DMV and with the BBB (Better Business Bureau). The get mad and said me "goog luck with your car" it seems that they know about are something wrong with the car (used sarcasm words). This is a very cheap dealership without a good reputation for me, and they are committing fraud with the customer, taking out their money and disappear without facing the problems.

Everybody that hear from this cheap dealership is aware now and do not do any kind of business there you are going to lose your money.

After pick up my car at the Porsche mechanic, I have the receipt of the final payment for the service and an estimate

for another service that is required, but unable to pay for it right night. I want to know if the dealership is going to respond me with my request or if not, to proceed with a legal resource. As said, they committed fraud and forgery by falsifying my signature in the documents. I contacted the owner one more time by phone and gave him the opportunity to pay for all the repairs without having to enter in a legal situation, but he was refusing again to take responsibility for his actions.

Final price to fix all the damage in the car

I spoke few minutes ago with the Porsche mechanic and he let me know 

that the car has damage in the fuel pump and lines. The total repair amount is $1,100.80 plus the towing charge $60.00. If these people are able to pay for all this cost I will be able to drop off all the claims as they are positive to help. 

Please notice that they have here not only the fraud claiming but forgery (for falsifying my signature) in the supported 24hrs form (they filed for me) when initially said me NO Return and never mentioned the form until Saturday nite. Knowing that they sent to you a copy of the form with my false signature.

 

Once more, time if Prespa agrees to run with these costs this could be the end of this bad experience with this dealership and to close and not go further with other legal processes. I need to know about them today since I need to give an answer to Porsche (they are waiting for me). If not, I will go ahead to paid with the low budget they left me, but proceed with my lawyers against them.

 

My position was always to return the car and I will let this clear, but now I am able to make the above agreement since I urgently need the car, I lost a job offer cause I needed to told the truth by not having a car; affecting me more economically.

False report and false form

I never signed a form in the dealership and this is not my signature. I claimed for a total refund and to honor their policy. The intention never was to comply with the policy. The "As Is" gets invalidated as soon a dealership tells you that they will help in the cost of the repair; however, I clearly asked to honor the return.

Again he stated NO RETURN! He never mentioned the need to fill out a form, she always stated in NO RETURN. And the one that can place a suit here is me for all the suffering and loss of money, and yes today I paid a towing service to deliver my car to the Porsche mechanic which cost me around $155.00 not included the rest of the repair which could be more than $350.00.

I never signed this form before. The tricky one here are them. 

As soon as, the car repaired all the cost including the $250.00 and the towing cost needs to be paid by them because I invested money in repairing a damaged car that he knows and that's why he pushed so much to sell me the car at 8 pm in the nite.  Yes, I took a computer with me and do the basically check for any codes, but, for example, mayor problems including electrical are not showed in computers. On my way back to home, I started to notice the car was low in rpm and shakes few times before arrived at my home. The next morning never started up.

On Thursday November 12th we sold the customer a 2002 Porsche Boxter. The customer came in that morning and drove the car and even connected the vehicle to a diagnostic machine. He found no issues and left to look at another vehicle at a differant dealership. Later that day around 7pm the customer "Daniel" returned and wanted to purchase the said vehicle. I was at the auction at the time and left to accomodate the customer, due to him having to drive back home to Orlando and couldnt come back the next day. The customer took delivery that evening and signed a Florida buyers guide that fully states "SOLD AS IS" he also signed our return policy form. That states you have 24 hours to return vehicle . As long is it doesnt have more then 100 miles on the odemeter from the date of delivery. That said. I received a call from Daniel the next day stating the car was having trouble starting. Keep in mind he never once mentioned he wanted to return the car. I told him to go get the car inspected and we would help him out and figure something out. He agrred and then called me again few hours leter. I again answered the phone and Daniel asked me if I would pay for the repairs need to fix the car. I explained to him. You bought the car "AS IS" then again I explained he needs to get the car looked at and see what the issue is. I also explained to him we would try and help him out. He agreed and said he has a mechanic friend who would look at it and get back to me. Then on November 14th two days later. I received this email from Daniel's mother stating the following.

Do you know that in Florida "fraud" is consider a felony? I don't know if you are able to damage your reputation since you advertise your dealership  "20 yrs in business".  
However, if you get the responsibility of your sales and are able to run with all the possible cost with the Porsche mechanic and with the wrong parts it may have, we are able to  stop every procedure already started against you. This will include the towing service he already settled with. So, call my son Daniel and work something with him.
You are the worst dealership and I am going to suit you for having false advertising in your webpage. I have lawyers that will be contacting you soon. Be sure to have your webpage clear by then. I have all texts, phone calls and evidence of everyhting even you try to delete any infomation from it. 
You last attitude with my son really pissed up and I dont care. The law is the law and when you post something as a business you need to comply with the ads you are saying, if not IT IS FRAUD!
And by the way, The one need to have luck now is YOU. Business are business and business with bad reputation is not a good business. Cheap.
 
Then the morning of Monday November 16th we received a email notifying us . She has falsly and without merit placed a report on this site. Accusing us and making threats to us. We had full attention of helping her son. But after her actions. We plan on seeking legal action against her for false and melicious accusations.

Nowhere in the website stated how you will return the car, however, I called the owner immediately the next day morning and in the afternoon asking to honor the policy, and he said "No return". After that, we contact via text messages, emails, but never responded again.  

I have a two emails sent on Saturday afternoon, because I just informed them thet I placed a claim with the DMV and BBB they don't know about my report with you by that time. They just used "sarcasrm" a desire me "Good Luck" with the car, which this implies in my opinion that they do it in purpose and now the car was not working good when he sold me the car.

They also, write that the return need to me make withing 24hrs by filing a form (which he never mentioned on Saturday, but telling me NO RETURNS, he just wanted to gain time for the 24hrs to expire and not comply with their policy which still there open to everone.

I have in records the two emails in the case you need to read it.

In conclusion, the point here is that I contacted the owner twice on Friday and asked him for a total refund based in the policy, they just gained time with me and stated there is no space for a return. But, when I placed the claims with all these agencies and I told him, he email me back with a lot of threating and wishing me "good luck with the car" which it sounds to be that there was a bad intention with all this.

You are correct; their website does state, “Return it with-in 24 hours with no questions asked.”

Your complaint implies that you did not actually return the vehicle within 24-hours. Where on their website does it state that phone calls and email requests within 24-hours are an acceptable substitute for returning the vehicle to the dealer?
