I think what NextCard has done constitutes ACH Fraud (Automated Clearing House Fraud). Once a fraudster has a consumer's bank account number they can come up with a number of reasons to take money. There is definitely something you can do because the law is on your side this time. You must go to your bank; a phone call will not do in this case. Go to your bank and request an ACH Fraud Form. Don't let your bank fool you, it may call it's form by another name, get it. When you fill out the form you should do the following: 1. Put the bank on notice of unauthorized withdrawals from your bank account, i.e.; the bogus "over the limit fee" and the others. 2. Request the bank redeposit those funds in your account. The bank can do this automatically through the automated clearinghouse it uses. 3. Put a block on any further withdrawals by NextCard. If you do this immediately you should recover quickly. Received my new December statement. What a surprise.. Not only was nothing done to reconcil the mess they made of my account, but once again, they've added a new $29 over the limit fee jacking up the balance again, not to mention all of the finance charges that have accumulated all of this time. Does anyone have any ideas as to how I should go about getting this cleared up???
