I went to Landmark Chevrolet to purchase a car because I received a pre-approval letter in the mail. When I arrived I waited around for a salesperson to help me who just referred me to another guy who referred me to another guy. In making the purchase the sales person Victor Salinas asked me for a down payment and I advised that I could make a down payment only if her can take it in two payments and allow hold my check.

I gave him a check for $1000.00 but the next day when signing my contract advised him that I could not do the 1000.00 because I did not want to take the money from my 401k. I told him that I could do the 500.00 on 9/23/04. He said ok and filled out the hold form for my check and I was suppose to bring him the 500.00 on 9/23/04 and he would give me my check back.

When I awoke on 9/23/04 to go to the bank to get the 500.00 I did not have the available balance in my account. Mr. Salinas had already deposited the check for 1000.00 into my account and my bank paid it on 9/22/04. When I called Mr. Salinas that morning he admitted to the mistake and said that he could not help me. I then went to Hilda Garza, the sales manager, who promised me that she was sorry but she would get me the 500.00 check on Thursday 9/23/04.

On my way to Landmark to get my refund I called Hilda who then advised me that the person she needed to sign the check was not in for me to come in on Friday 9/24/04. I arrived at Landmark on Friday 9/24/04 to find that my check was still not there, but in the mean time my account was now 200.00 overdrawn because of their mistake. When I advised Hilda that because of the principal of the matter I no longer wanted to purchase the car from them she advised me that if that was the case she was not giving me anything back.

I tried to speak to the GM, Charlie Moore, who would not come out of his office on Saturday, 9/25/04 so speak to me. I spoke with Roger T, who is suppose to have some type of control, who told me that he could not do anything until monday. For the whole weekend I was not able to make any purchases or pay any bills because of Landmark's mistake. As of today 9/27/04, I have called Landmark 2 times to speak to Charlie Moore or Don Fullen who are not returning my calls.

Do not ever purchase a car from them. From my understanding in speaking with a security guard at the location they have had to settle 3 lawsuits out of court for the same error and the company is not doing good on car sales at all because of the way they treat their customers.

Leave a $50.00 deposit. They will keep it everytime. These slimeballs send these letters out a lot. Not all people can get financing but some do. They suck. This is the worst in Houston by far. I know...I help people buy cars so they don't get taken.
