Identity Theft

Fraudulent Use or Possession of Identifying Information

Creates falsified documents (Drivers License, Bank Statements. Check Stubs, W4)

Submitting them to financial institution such as Banks (Drive Financial ETC) Providing False Statements to Obtain Credit

Forgery (Forging customer's signatures) forged my name on a credit application for a Tahoe.

A statement was made that an employee at Landmark Chevrolet Houston, Texas admitted that he has ran my credit multiply times to (a mutual friend of ours). I then, contacted the three major credit bureaus and ask that a fraud alert be placed on my credit history and requested that I receive a copy. Well, I got a copy of my 3-in-1 credit report from all three. Behold, there's 5 inquiries from Landmark Chevrolet.

I was mad; not to mention, at the risk of sounding dramatic, I felt violated. At no time had he asked me if this was ok and at no time did I give him/them permission to do this. 5/21/05 I called Landmark for the corporate office number to make a complaint. I was told they can not give that number out.

5/25/05 @3:45pm I called back to Landmark, asked to speak with the GM to report fraud that's going on in the dealership. They then forward me to the executive asst. voice mail. I left a message but no one called me back.

So I called Bill Heard and spoke with the executive asst. she notified me of the person I needed to speak with (Don Fouling) The Operations Manager and gave me the corporate office number. She told me she was going to have someone from Landmark Chevrolet call me back by the name of Rosa (Customer Relations Manager).

No one ever called back. 5/26/05 @8:45am I called the corporate office 1-800-833-0479. I spoke with a lady by the name of Kim Stewart. I gave her all the information I could on the salesman. A salesperson at Landmark Chevrolet has ran my credit multiply times without my consent and this needs to be taken care of. I stated to her that I had proof of this and she asked if I could fax over the credit report to her which I did.

I also mentioned to her that According to the Federal Trade Commission's (FTC') interpretation of the Fair Credit Reporting Act (FCRA' or the Act'), merely requesting information from an automobile salesperson regarding a vehicle -- including quotes for prices and financing -- is not a business transaction initiated by the consumer, which would have enabled your employees to obtain a copy of my credit report without my permission.

This kind of inquiry shows up as a hard inquiry on a person's credit report and also decreased my credit score. She said that was very unacceptable and she was defiantly going to get to the bottom of this. She told me she was going to contact Rosa who's the customer relations manager at Landmark and alert her that allegation has been made on the salesman.

5/26/05@11:30am Received call from Rosa at Landmark 281-820-8126. Stating she had received an email from the corporate office regarding allegations made on an employee at your dealership. I explained everything to her that I stated to Kim at the corporate office. I explained to her that I received my credit report and Landmark Chevrolet was on my credit report 5 times, and I have never ever signed anything for Landmark to run my credit.

5/31/05 Received call from Rosa Customer Relation Manager at Landmark she stated that she has a credit app with my signature for a Tahoe back in Feb, but it was decline that the salesman had given her. I told her if she has a credit application with my signature then thats a fraud document for the simply fact I have never signed a credit app or ever wanted to purchase a vehicle from there.

I then asked if she can fax me a copy of the credit application that I supposalably signed She stated she could not I would have to speak with the GM.She said the GM will call me back today around 1:30pm. Well that has been 3days already still no call from the GM.

6/2/05 Called Landmark again after consulting with a lawyer regarding the credit application to get a fax copy of my credit report. Spoke with Rosa she stated that she can not give me a copy. I stated to her In fact, in order for your employees to have legitimately run a copy of my credit report, they needed to obtain my written permission. Your employees did not. And if you would like to contend that your employees did, please provide me with proof that I authorized him to obtain a copy of my credit report.

She asked what I was trying to get out of this. I asked what kind of question was that. How would you feel if someone was running your credit and staking you? However she did mention that the entire management staff received an email of what was going on including the salesman i have made allegation.

Later, I begun to received private calls, and messages that he was going to find out where I work because I had messed with the wrong person, but comes to find out he knew because of my credit report.

Such as Identity Theft (he stole my SS number ran my credit without my permission)

Creates falsified documents (Drivers License, Bank Statements. Check Stubs, W4) He also makes Drivers License, Bank Statements. Check Stubs, W4 for his follow employees. Andre Franklin was his partner he can verify what went on in that dealership. He was a previous employee at Landmark.

Submitting them to financial institution such as Banks (Drive Financial ETC) Providing False Statements to Obtain Credit (if someone came in did not have a job he would create a one for them as well as make them a check stub and have someone that he know verify employment like they work for that company. A company he used was Riser Home Health which does not even exist.
