My husband had major back surgery last year. Realizing that my income would not be sufficient to enable us to pay our mortgage as current we filed with the mitigation department (Karen Barrile) for Hardship to delay or extend the length of our mortage agreement.

Our Hardship Mitigation paperwork was passed on to 3 different individuals. Each time we called to check on the status of our request we were told they were working on the request, or they had just received the request, or they had not yet had the time to review the Hardship Mitigation paperwork. Three months passedand we still had no decision from the Mitigation Department. By this time the office located in Florida, department of collections began calling my home constantly with the threat of foreclosure.

I would explain the Texas office was working on our Hardship mitigation. The collection individuals in Florida I spoke with would look up the account on their computers. They would then see the paperwork for the Hardship Mitigation was in process. This did not stop the letters nor the harassing phone calls we received at home.

We again called the Texas office explaining that we were being harassed by the Florida office, even though they were fully aware of the procedure in process as noted on their computers. The Texas office told us not to pay any attention to the calls we received from the Florida office and not to respond to them in any shape or manner. We continued to wait for the mitigation department to make their decision concerning our hardship paperwork.

After 3 months, we again called the Texas office to check on the status of our request. We were informed at that time the paperwork was now void. All paperwork concerning this request would need to be resubmitted to the Texas office.

It was now time for my husband to return to work. He was released by his doctor as fit to return to work. We still did not have the amount past due in which to pay the mortgage company. Since he had only just begun to work again we needed time to accumulate the past due funds. The Florida department of collections continued calling and harrassing us. My husband and I realized that if we took all I had in my 401K account, plus our income tax return, we could make up the past due amount the Florida office was harassing us for. Besides, my husband was returning to work, and we were tired of being harassed. Too much time had now elasped. The Florida office called again, I told them to "Close" the case. We would be paying the entire balance past due on the account with our income tax return and my 401K savings.

What I was unaware of is as follows. I was unaware that and invividual who is incapacitated by a medical illness and has requested assistance would receive a "Bad" credit rating against their credit history. The paperwork from the Loss Mitigation Dept. in Jacksonville, Florida reads as follows:

During the time that our department reviews your case to determine if we may be able to offer you a loan workout, normal default servicing procedures, including collection and foreclosure activity if necessary, and credit bureau reporting will continue until the workout request is approved.

Ours was never approved, just passed from person to person for 3 months, therefore this went against OUR credit history. I guess if a company screws around with your request for 3 months they have the "right" to ruin your credit history. Even if the company receives the full amount due because you discover a way in which to resolve the situation and the harassment.

My husband and I would like to refinance our home. We now have an 8% interest rate. We cannot. Our history is now ruined, at least until February of next year. Homeside lending reported us delinquent 3 times, the 3 months we were pending the decision of the Hardship mitigation.

So beware of this company and how it "helps" you. The assistance you receive may include a dreadful suprise.
