Frederick J Hanna & Associates, as Palisades Collection, garnished my checking account for over $9,000.00, which they say I owed to First USA Bank.

When I called Hanna & Associates and told them that I had never heard of First USA Bank, the collection agent said that there was nothing that they could do about it because there had already been a judgment. He would not give me any more information about the alleged "debt."

I am a senior citizen who is no longer able to work. I have $21.00 in my checking account, and have never owed any merchant over $9,000.00. I know several other seniors who have been contacted by Frederick J Hanna and intimidated into paying money they did not owe, even when the debts were not legitimate.

When I was much younger, I worked as a temp at a sleazoid collection agency (I am embarrassed to say). Banks and other legitimate creditors write off delinquent accounts and sell them to collection agencies for pennies on the dollar. The collection agency then attempts to collect the full delinquent debt amount, often falsely telling the consumer that they represent the original creditor. Since the original creditors have already taken a tax write-off, they could not legally accept the full debt amount even if it were offered to them. If the collection agency can not collect on the debt, they might sell it (along with many others) to yet another collection agency, whose tactics will probably be even more questionable.

It is a sad commentary on our society that people use harrassment and intimidation--not to mention our legal system--to get rich.

It looks like Rip Off Report redacted my links on how to fight debt collector lawsuits for Hanna and Zwicker, and for help blogs.  For help with the lawsuits you can do a Google search for a book and webtsite by Allen Harkleroad titled “Stick it to sue happy debt collectors.”  The help blog I linked is Next Level Unlimited Credit.  I do not have any stake in any of these sites, I am just posting to try to help other consumers.  I do understand why Rip Off Report redacts links though.

The Georgia Supreme Court says Hanna is a "law firm," so you have to submit a bar complaint vs. them (and not a consumer complaint with the state OCA or federal FCC -- but fine if you do that too anyway).  You may submit a bar complaint vs. Fred Hanna (the owner of the "firm") and any atty. that may have contacted you that also violated bar rules for atty.s:

Get a referral to an attorney. What has me concerned is that they obtained a judgemnt on your checking account. For that to have happened, you would have been served. if you were not properly served, you can go before the judge yourself and have the garnishment immediately lifted. If you were served, did you appear in court? It sounds like this is a default judgement that unscrupulous debt collectors rely on. They count on folks not showing up to court and the judge automatically finds in their favor. You really need a lawyer, as the company is compelled to produce evidence the debt is valid, they have to prove they are legally entitiled to collect the debt on behalf of their client. BLACK MOLD When we named Fred Hanna, a Toxic Waste Debt Collector, we had no idea we would be foretelling the future. We are starting to hear stories from all over Georgia about the operations there and it appears the lawsuits and government sanctions may be on the way. We could use some true insider information: Here's our understanding at this point: There is a health danger at several of the Hanna operations so bad that the government's OSHA has come in on at least two occasions. There is talk of someone - perhaps Fred or Dennis - signing off on OSHA documents and falsifying government paperwork. More to come as we sort through all the material. -------------------------------------------------------------------------------- It seems that Hanna will lie on court affidavits about his position and most affidavits attached are bogus in the information stated. Fred J. Hanna is NEVER to be trusted, his court filings should ALWAYS be challenged. Fred is concerned about one thing; separating you and your money. This is one of the WORST third party collection agencies ever Contact Mr Hibbs, get the name of an attorney from him and FIGHT BACK!!
