My father (Irving) died of cancer in Florida in 1991. Prior to his final illness, he had prepared a will and a trust, which he kept in a bank's safe deposit box.

My father was a widower who had married a widower (Shirley) later in life. Prior to their marriage, they entered into a prenuptial agreement in which each agreed not to make any claims upon the other's estate. They each intended to bequeather their estates to their own children and grandchildren.

Three months before my father died, he was operated upon to remove his cancer.

Following his surgery, his wife sought to break her prenuptial agreement. To do this, she enlisted her daughter's Boca Raton law firm (Hunt, Cook, Riggs and Mehr) to draft legal documents for my father to sign. More than a dozen drafts were prepared. My father refused to sign them.

Two days before my father died, my natural sister (Paige) sent two lawyers (Schwartz and Zakarin) to my father's Boca Raton Community Hospital bedside on her behalf. Those lawyers reported in a written memo (as well as sworn testimony) that my father expressed "extreme distrust" of his stepdaughter (Mehr) and mentioned the documents he would not sign.

On the morning he died, his cancer ruptured his stomach. A doctor resuscitated him and started him on morphine under a DNR (Do Not Resuscitate) order.

Under these circumstances, my father signed two conflicting dispositive documents. The first was a new will that was written into my father's medical record. The second was a deed that was prepared and brought to my father's bedside by my stepsister.

The first doctor's action seems to be an innocent but stupid mistake. When asked by my stepsister's law firm to sign an affidavit that purported that the contested deed was not contradicted by what my father told him, he refused and testified to the contrary - that the deed did in fact contradict what my father told him.

The fraud by my stepsister (Ryna Mehr), her law partner (David Riggs), and others is fully exposed by the evidence posted on my website.

Fighting this fraud became a nightmare, and ventually "extrinsic fraud" was committed to prevent me from participating in the trial. In particular, the witness sequestration rule was incorrectly applied to remove me from the courtroom as the trial started. I was not just a witness, I was the party who had initiated the proceedings and a party who had an interest in those proceedings.

I was never called to testify at trial. Nor were the two lawyers who visited my father two days before he died. Nor was my father's sister, who testified in deposition that my father even told the Defendant NO on the morning he died. My aunt's testimony is collaborated by the Defendant's deposition. Everything else is collaborated by the Motion in Limine that the Defendant filed with the court just before trial in an effort to suppress the evidence concerning my father's intentions prior to the morning he died.

Because of all the fraud, the court upheld the contested deed. The court of appeals refused to address the fraud and upheld the trial court without offering an opinion. Because the court of appeals refused to write an opinion, the Florida Supreme Court refused jurisdiction, as did the US Supreme Court.

The Florida Bar also dismissed all complaints. The fraud here included the finding that my stepsister did not prepare the contested deed. This finding contradicted the deed and also my stepsister's testimony. For example, the deed actually records the fact that my stepsister prepared it. When asked to reconcile its findings with the facts, the bar refused to.

During the past several years, I have proposed to the legislature three specific changes in the law that would allow individuals to protect themselves and their families against such fraud. The first proposed change actually echos a recommendation that was independently suggested by the State Medical Association and endorsed by nearly every medical community in the state of Ohio. These changes have also been endorsed by numerous individuals and organizations, including a former secretary of elder affairs in Florida who is currently that state's AARP director. Nevertheless, only one legislator has been willing to even address the problem, and his effort was killed by the state bar association.
