Pre-paid landscape design services were purchased. Sales representative told me before I signed contract that the design would take two weeks to complete after the contract was signed and the landscaping itself would take another 2 to 4 weeks after a design was finalized. He told me that the plan could be completed during autumn.

After the contract was sent in, several days later (on Sep. 14) I called to confirm its receipt and get an estimate of design completion. Again, I was told 2 weeks.

In twelve days (on Sep. 26), I called again for an update, and was told that no work had been done on my design but it would be completed in 2 weeks.

On October 4, the rep came to our house to take measurements of our yard and told me that the design would be completed in two weeks.

Meanwhile, the season to plant grass (which was to be a large part of our landscaping) had passed. On October 20, after the most recent promise of design completion, I called the owner and left a message that I was a very unhappy customer. Before the owner could return my call, the rep saw my message to the owner and had a set of plans, which had been sitting in the office for several days, rushed over to my house.

The owner called me later that day, took notes of my complaints and said it would be Monday, October 23rd before he could get back to me. He did not call on the 23rd and calls from me to him on Tues. the 24th and Thurs. the 26th were not returned until I received a voice message from him on Mon. the 30th. After swapping messages several times, we finally spoke on Thurs. Nov. 2nd. I expressed my disatisfaction regarding the quality of service and the series of missed promises and requested my money back. The owner basically said that I paid for a design, I received a design and therefore he would refund my money. The missed deadlines, the unmet expectations and poor service did not influence his decision.

In the landscaping business, consumers must pay for design services up front and I did that. The rep worked very hard to earn my business and did win it. However, once I sent them the money, I received lip service to my concerns, missed deadlines and a lack of care to expectations which the rep created.

The fall planting season was totally missed because of their repeated delays. At the time I complained directly to the owner, I had not received plans, did not care to receive them and only wanted a refund of my money. A refund of my money is still what I want.

You signed an open-ended design and construction contract that did not specify, in writing, delivery and completion dates? No wonder you got screwed! The landscape company is well within it's rights to drag your project out forever! No penalty clause in the contract for missed completion dates? You would have had a reason to file a formal complaint with your State Architecture or Contractor Licensing Board. Very effective! Talk is cheap! Promises are cheap! "There's a sucker born every minute!" Dale K. State Licensed Landscape Architect p.s.; Was the designer a licensed Landscape Architect? You might want to check with your State Licensing Board, as here in CA. we are required to include delivery dates for our design services in the contract....by law!
