E Bay seller bifficus is selling laptop batteries with the claim UpStart Battery is the only brand on eBay with a Lifetime Manufacturer's Warranty .  Sadly, this is a bold faced  lie.   I purchased an HP replacement battery 8-12-07 which has

completely failed. There is some confusion as to who to contact regarding warranty claims.  One is led through Up Start Batteries to Certified Batteries identified as the manufacturer alluded to performing the warranty replacement. This is copy and pasted from the Certified web page: Laptop batteries are excluded from this (warranty) program .

To this day bifficus on E Bay continues to perpetuate this scam on laptop  batteries sold. This seller has been active on E Bay since 12-28-2001.  This seller carries  the Top Rated Seller Icon ribbon for which E Bay furnishes the following information:

It's okay that you said the last post was your final. You are not obligated to respond at all, but since you did we now know what is really going on.

I don't feel by your last post, that ebay in this case did anything wrong. We are at truth time now. I also understand why your are angry but I don't think you really feel that ebay had anything to do with a fraud. You just don't want to pay return shipping since it is more expensive then the battery at this point. But that is what happens with electronics. For example if you bought a GPS unit 5 years ago for $1000 and had a lifetime warranty,,if it broke today they could send you one that now sells for 150 bucks and would be nicer then the original and have more features.

also to note..you can knock those batteries for being china..but guess where the original battery in an HP laptop (and just about all the other parts inside) are made? Yes ..rice land. As a matter of fact, around the time you purchased that HP laptop, HP had to recall 70,000 batteries..all made in...you guessed it...China. They were exploding. No one was hurt fortunately, but laptops were blown up and burnt..not good.

I do however feel the owner of the company may be a little arrogant. I know you didn't want to read though the 1700 comments at the time, but I took a few minutes to read through the 5500 or so (power scroll and look for the reds and gaps for follow up)...and copied all the negatives. Bear in mind...this is a small amount of negatives compared to well over 5300 that  were all excellent,,but the ones he does reply too give me a bad taste..I might not have bought from him if I had read these comments at the time..I also found one follow up. I was actually looking for follow ups to see if there were any warranty issues..did find complaints about...return shipping of defects..what do you know..I can not figure how ebay hid anything or conducted fraud.

.on this Chinese battery issue. Certified Batteries ultimately declared my battery was the last of the batteries  with a lifetime warranty, and  would replace it for $24.85. I gather from their missive Im to send the failed battery to Canada, I assume at my cost.

 

Sort of gets confusing from there. Something about : Upon receipt of your old battery, we will test, prime and recondition it on our battery analyzer. It will then be retested. If the battery passes the test, it will be returned to you. If not, it will be  replaced.

OK, I give up. After the $24.85 plus shipping to Canada Ill

Have about half the price of their current F4809A, which now

Sells for $20.00 less than I paid in 2008. (Scratch my references to 1997. That was in error)

Second missive from C.B. contains a new caveat: I have also noticed that you may have posted a claim on Ripoff Report (link below), since we are in the process of trying to help you out with the Lifetime Warranty Claim. We will need you to remove the post before we will proceed with your claim request.

You stated in your response..

So what I may have overlooked here, is that the page in 2007 when you made the purchase is different. In the above statement you say the purchase was on 9/9/2008, but in the report you state it was purchased 8/12/2007.

What I can assume has happened judging by what you are saying, is that the battery you purchased did not have a lifetime warranty, but you were mislead by this because the seller had logos on the site for other batteries that did have a lifetime warranty?

If this is the case I can see why there is a problem. Unless I can see a snap shot of the exact page and info regarding the specific battery from the exact date you purchased, I really can't defend or blame either side.

But in reality the average lifespan of a laptop battery is 2-3 years depending. At this point the only thing you can really do is continue to fight this out if you have the evidence that you were defrauded. But it will take some effort and you may get nowhere.

What I would do in your case is try to work with this seller and come to an agreement where you can purchase another battery at a discount that does have the lifetime warranty. Sometimes the sellers rather do this then deal with disputes and complaints. It also would be nice if we could have a response from this seller to hear both sides as there is typically 2 sides to every story.

I can understand if you honestly believe you were defrauded why you lodged a complaint here. I am not in your shoes so it is not fair of me to prejudge or jump to conclusions. If I have done so I apologize.

But at the same time, all the ratings and feedback were left from other buyers. Ebay has not hidden any negative comments. As I posted earlier, the status of the seller is based on feedback from the buyers..it is not fabricated by ebay to defruad anyone, it is there to help the buyers decide if they wish to use that seller. Now if a seller has a few negative issues, but has a substancial history of positive transactions, that is exposed as well, Ebay is trying to be fair to both sides, not just the buyers, but again, nothing is hidden.

As you stated, buyer beware, that is the case anywhere you buy anything. But at least the feedback and comments gives you some idea of who you are dealing with, the items as described, shipping and handling times, and communication. This seller according to the buyers ratings, has been doing this almost perfectly, at least for the past 12 months.

I went back to the sellers website and looked for the lifetime warranty info.

This is what I found...

*Lifetime Warranty.


This means that even if some day (God forbid) that Certified Battery shuts down, you can still get your product replaced directly from UpStart Battery's Master Distributor.

That has to do with the star system. The BUYERS are the ones who determine this, not ebay. The criteria is as such..

As you can see, over 4500 BUYERS have rated this seller and in all categories this seller has been rated from the BUYERS as almost 5 star. If the sellers rating goes below 4 stars from the BUYERS, ebay will remove the power seller status.

I honestly do not know why you are having any problems. How did you pay? If the battery you purchased has an implied lifetime warranty, then I can't understand why you are having any problems.

I was not trying to provoke you, I hope you understand. I was trying to help. All you need to do is place the cursor over "help" on the top left corner of the ebay homepage, and click on resolution center. I have done this before and always worked out to my favor.

If the seller does not respond, you win by default. But judging by the ratings which were submitted by the sellers other BUYERS, not ebay, it would seem logical the seller will respond.

Representatives are available from 5AM-10PM PST, 7 days a week. If you want faster phone service then click on contact us and then "call us" and you will be given a PIN number.

As far as reading the feedbacks, you don't have to read all the POSITIVE feedbacks as there are thousands, but only a few negatives. I just click through a few pages and scroll down and you can see the red - icons which stand out over the thousands of green+ and a few gray neutral.

I am not trying to tell you how to shop. But if you choose to purchase an item from a seller who has ANY negative feedback comments, wouldn't it make sense to read why?

But bottom line here, I am not defending this seller or trying to blame you. I am trying to see both sides and help you get to the bottom of this. But to blame ebay for this seller being top rated when it is the buyers who decided this, is really a little unfair.

If you purchased a replacement battery and the one you purchased claims a lifetime warranty, then you will get it warrantied or a refund. This seller has been active since 2001, trust me, he isn't going anywhere just to get out of one battery warranty.

.heres what has transpired, strangely, almost EXACTLY as youve suggested:

[1] I called the supplier- manufacturer; (Certified Battery which IS the actual seller)  & they confirmed there was no warranty.  I had a print out of the original auction page from  the purchase on 9-9-2008.  It differs slightly from their current page, but BOTH allude to a lifetime warranty, the page from 2008 alluding more specifically a lifetime warranty exists, with no qualifications.

[2] The seller bifficus lists both UP START and Certified Battery logos on the auction site.

[3] The Pay Pal transaction went through CERTIBATRY. The seller is bifficus, the sellers E Mail is [email protected].

These are obviously all representing the same entity.

[4] Hell no, I didnt go through  over 1713  99.3 % positive feedebacks POSTED AT THE TIME I ORDERED to ascertain if a like satiation existed. Why should I? I relied on E Bays rating and quite frankly the 99.3 %.  E Bays Power Seller rating at that time also generated contributed to my trust. Foolish me!

[5] For whatever the criterian has changed, this seller went from being a Power SellerIn 2008 to a Top Rated Seller currently. A 99.6% rating SHOULD assure a legitimate, trustworthy seller.

[6] Your quote:

This takes you back to the same worthless page on which one may address a VERY limited scope of problems (where one started).   E Bay is basically  incommunicado with their customers conducting any specific dialogue aside from their limited perimeters BY DESIGN! I  WAS able to contact E Bay by means of phone (
866-934-9647 with furnished pin number). I was told the limit of 45 days had elapsed and basically there was nothing E Bay could or would do.

In closing, Ronnie G, I might add Ive been buying and selling on E Bay for over 12 years and am an early user with a six letter user name, with nearly 600 transactions, all 100% positive. I also have a rather thorough of knowledge "of how E Bay works".  This knowledge base is being expanded with this current issue.   E Bay apparently couldnt care less what claims (on the auction page) their Top-rated or Power Sellers make to sell their wares. There is an icon next to the sellers rating which I clicked and found this. Since it is publicly available on ebay whether a member or not, there is no legal or ethical problem posting it here. Direct phone # to the CEO which he asks buyers to call if there are any problems or questions..

Not to defend ebay or bifficus but typically you contact the seller first for warranty issues. What was confusing? Just asking, not trying to take credibility from your complaint. Did you contact the seller and if so what did they say? A phone number for questions for Certified Batteries is all over the page [(877) 999-5559 ], did you try calling.

As far as the limited lifetime warranty info it does state this I copied also..

"UpStart Battery is the only brand on eBay with a Lifetime Manufacturer's Warranty. Compare that to the many sellers of generic no-name batteries and chargers. If the seller goes, so does your warranty"

It does state it is a manufacturer's warranty so perhaps that is the confusion? Either way, call them and ask how to handle it.


As far as the Top rated seller status, they have a history of 5,692 transactions in a 12 month period have 23 negative feedbacks. Did you read the comments before you purchased? I agree when you state "Caveat emptor", always the buyer should beware. The company overall has a good track record of positive feedback and a substantial selling history, but this doesn't always mean they won't mess up. I tend to buy from sellers that have 100% positive..but in the 98% range or greater I will consider. This seller is in the 96-97% area..so the buyer is forewarned there were some less then positive experiences.

I would agree Ebay is being lenient for allowing this seller to keep a top rated seal with 23 negatives in a 12 month period, but considering around 5,670 were positive, this seller is obviously not a fraud. The ratings go by a percentage because the more transactions someone does, the more chance there is for a mess up. And sometimes the companies try to make good but the buyers refuse to cooperate. No one is perfect. And THAT is the reason they also post the feedback score. Ebay doesn't hide anything.

The main thing is, to make sure the warranty is being honored. Did this company refuse to honor it when you contacted them?

If not, you should absolutely lodge a dispute with ebay. If this company is advertising a lifetime warranty on the auction page, and then excluding it from the warranty on the sellers web page...you have a good case if you purchased it through ebay and they are not honoring the warranty.
