Complaint Review: Bna Holdings - dba Cottmans Transmission - Tallahassee Florida

this is what i have faced in the last year and 1/2, in october of 2002 i was contaminated with a chemical that caused acute dermatitis, it started a skin problem that i went to the hospital for. then in june i got hit with the same thing again, this time it was worse i went to a doctor on june 18th at this time i was informed by bob abney that he didnt have an workmans comp policy. the doctor told me that i had contact dermatitis and need to follow up with a dermatologist.

i told my boss this and showed him the report sending me home to heal and rest, this was on a friday and i was suposed to work saturday. my boss complained about me not being able to work. monday morning i went to work and the rash on my arms was a little better. by lunch time my arms were emflamed again, burning, itching, painfull rash. i tried everything from over the counter stuff for poison ivy, rash ointments etc, to prednazone prescribed by my doctor. after 1 week i contacted the doctors office about the meds not working, they gave me pills to help with the itching, didnt help just got worse.

during this time i told my boss that i and another shop employee needed medical care. he didnt lift a finger to help, week after week myself and the other employee suffered with a skin condition that got worse. a month later i was still working and suffering this condition, a customer pulled his hand back when i tried to give the man his keys. during this last 2 weeks i was having a harder time every day with my nerves and temper. i was exploding on everyone i had no patience with my children, fellow employes, and the public in general. i felt like everyone was looking at me like some kind of lepper. a desised freek it was disgusting, flesh was litarly falling off of my hands. it got so bad that i refused to do any work on the morning of july 18th, i started looking for a dermatologist.

every place i called wouldnt see me accept sherman skin and cancer clinic. bob abney was suposed to make arrangement for me to be seen, i was told by bob abney to be at the clinic at 1:30 july 18th. i showed up at 1:20 and was told by the receptionist that no appointment was made. i was not allowed to make a phone call from the sherman clinic I was told to go down the road to call bob and have him call them. this made me very mad so when i left the building i said "f***". i called bob abney and told him i was refused to be seen because no appointment was set. i returned to the sherman clinic and the receptionist told me that they wouldnt see me. i asked to talk to the doctor or the manager and was told that i needed to leave. when i left the building i said "the b***h". a man from inside shermans came outside and tried to fight me.

my wife stopped the altercation by interveining. upon returning to cottmans i was admonished by bob abney for the outburst at shermins. he had no concern for my pain and suffering all he was concerned about was that i had a cottmans shirt on. after that i went to the hospital, the doctor told me i had acute dermatitis and to take prednazone keep my arms in cool wet bandages i was told to stay home for 7 days then follow up with a dermatologist.

so i went home called bob abney at home to tell him i wouldnt be at work for a week, he wasnt home so i left a message this was at 8:45 at 11:30 he called me back yelling at me to be at work on the 19th of july. I went to cottmans at 11:30 on july 19th to talk to bob abney about the injury. when i got to the shop i was cussed by bob told that i wasnt allowed to say anything i was to listen and not say a word. i was told by bob abney that i was going to come to work and answer the phones deal with customers and preform my job he didnt care what the doctor said i was going be at work." this isnt the army i dont care what that doctor said" was his response.

i told him i wasnt going to come in until i was cleared for work from a doctor. he told me if i didnt come to work that i was fired, i told him that i wasnt coming into work so go ahead and fire me now then. he told me "your fired get your fu__ing tools and get out you have 30 minutes.

i walked out to the shop and told the shop i was fired and needed to get my tools. he followed me into the shop yelling "you are not fired you wont get paid for the 7 days off work" he kept trying to tell me he didnt fire me over and over again. i went home and filed for unemployment. after 3 weeks i went to colorado springs for a job, i worked there for 2 weeks and had another reaction to the fluids in the shop. on the 29th of august i went to the doctor for the acute dermatitis again, and was told by the doctor that i may need to change professions. the petroleum fluids was causing an immune reaction in my hands. i returned to work and was fired. he said i was doing a good job, encourged my wife to look for an appatment the week before. and the same day i went to the doctor i was fired.

that night we went home, on the way home our car broke down we didnt have enough money to pay a mechanic to repair the car so i had to repair the car. this caused a severe reaction on my hands.

by the time we got home i had responses from unemployment office, they didnt have a record of me working for cottmans under bob abney. he never setup an unemployment account with them. altho he was taking money out of my check for unemployment tax. i had to have an appeals hearing to prove i was employed by bna holdings , inc. , bob abneys company. also a responce from bob abney per the workmans comp injury. it was a slanders and personaly insulting statment ment to mislead the department of workmans comp. bob abney has broken several local, state and federal laws. but i cant get anyone to listen.

on january 30th 2004 i received my w2 from bna holdings inc. , stating that i earned $25,300 in total earnings and that he reported that he only took $4100 for taxes from my weekly paychecks. I have proof that he took over $6400 from my check. i informed him that he stole $2300 from me and i wanted it back. i told him i would report him for grand theft, he asked me to give him 2 weeks to correct the problem , that he would take it to his accountant. after a month i called him back wanting my money he refused to give me a corrected w2 or the money back. so i tried to get tallahassee police dept. to investigate the grand theft, i had to insist for them to even to take the report.

the first 4 officers i talked to tried to tell me it was a civil matter. i insisted that i had fully read the florida statutes and had researched the crimes this clearly fit into theft and fraud crimes. still the tallahassee police dept drug there feet. i took them proof of the offense and all the pieces necessary to prove that he used fraud to steal $2300 from me in 6 months. i also told them that i wasnt the only employee that this was done to. it took a meeting with a lieutinent to get the investgation started. a sloppy and lax investagation followed by the detective. she called bob abney talked with him took his statment he didnt deny the evidence i had presented to the TPD he was asked to send supporting paperwork to explain the difference. he refused to comply with the detective, so she told the states attorney that she didnt think she had enough evidence to have probable cause.

so that was the end of her investigation. i called her sergent. he told me the case was closed and that was it period they were done with this matter. so i called there lieutinent told him what had happened and asked for his help on this matter. he said he would check and see what the detective had done and call me back. the lutinent called and said that they would go back to the DA and try to get a supoina for the information the detctive asked bob abney for. bob abney was served with the supoina and responded that he didnt have any records. this is the end of what the tallahassee police department conciders a criminal investgation. now with all the information i supplied the police department they dont think that they have probal cause. the whole time they have repeatedly tried to pass the buck to the irs. it is simple he used fraud to skim about $85 a week from me not the irs.
