We purchased a 1990 Ford Probe from Big Hearted Smitty's. Two weeks later, the linkage in the transmission wrapped up in it. We had it towed to a local transmission shop. Jerry at Big Hearted Smitty's called and told us not to let the shop even look at the car, that he would go and pull it, and they would fix it for us. The cost was to be $800.00. (This was after already paying $800.00 down, and $200.00 worth of payments.)

We were put off all week, until finally he called and said it was ready. When we went to pick it up, he informed us that it still wasn't right, because they had put a non-turbo transmission into this turbo car. (Without our permission) He told us to drive it, and if we weren't satisfied to bring it back.

We drove across town about 10 miles. It would not stay running; it shook and vibrated; you couldn't go over 50 MPH, or the turbo would overload, and everything would shut down. We immediately called him, told him it was worse than when we brought it in, and took it back. (We had given him a check for 1/2 of the repair bill--$400.00) When we got back to the car lot, his whole attitude changed: he said the car was fixed, that we just weren't going to be happy with it. He said all he could do was put us in something else, that he could not afford to pay his mechanic to put a turbo transmission in it, and that he couldn't find the right transmission.

We told him we wanted to think about it. He informed us that if we didn't make the trade then, that tomorrow would be too late. That he wouldn't make the same deal if we didn't sign papers on it that night. So we were put in a 1990 Chevy Lumina. We had put $800.00 down on the Probe, plus $200.00 in payments, plus $400.00 in repairs. He only gave us credit for $459.00. Plus he wanted us to pay the other $400.00 in repairs owed on the Probe! We have four children, and at this point were faced with NO transportation! We drove the Lumina home. It never started AGAIN!!!

We called him. He said he would come out and get it and repair it. In the meantime, we stopped payment on the $400.00 repair check, and told him this. He came and got the car, (under the pretense of repairing it), and informed us 4 days later when we went to check on it, that he was done, that we weren't getting the car or our money, because we stopped payment on the check for repairs on a car that we no longer owned; and which the repairs were never completed on.

PLEASE HELP US GET OUR MONEY BACK!!!!!!!!!
