Hello my name is Jim nichols and I am reporting Bay Electric Co. of Yorktwon Va. Initially we contacted this company as one of three electrical companies to get a quote for a 220 breaker, plug and cabling, as well as 2 110 breakers, plugs and cabling for the Business upstairs (venturenet Inc.)Their salesman Mark Biagas showed up and was nice enough. he indicated that he understood what we wanted and would give us and itemised quote for his services when we recieved the quote the dollar value of the quote was competitive with the other vendors. The quote was showed to me by Les Walker (the manager of Venturenet) and I didnt really look at it in detail. I only looked at the price. Not realizing that he had quoted only half the job I assumed it was good quote. Because he was the most local of the vendors I asked Les to call him back and see if he could improve on his price and move towards getting the work done. Les called him back and asked him what his time frame would be to do the work.

The next thing we know his people were in the building the following monday doing the job. Les was not here that monday. I should again note that I am Jim Nichols the building owner and the owner of Hampton Roads Computer. I saw them in here doing the work and assumed that a deal had been struck and the services ordered by Venturenet Inc. while in the building they accessed the upsatirs attic to run cable. The pipe carrying water away from air conditioner was broken. water began to leak into the room below the air conditioner. It continued for 2 days. This because the room wasnt in use at the time except to store computer equipment. on the 3rd day water was discovered in the room the ceiling was soaked. The floor was covered and thousands of dollars of computer equipment was saturated. It was sheer madness around here for 2 hours while everyone in the building worked to move the equipment out of that room and clean up the mess. I climbed into the attic to identidy the source of the water. Thats when i found that the plastic leading away from the air conditioner has been broken. I immediately realised what had happened. The men working upstairs running the cabling had stepped on the pipe and broken it. I cannot say whether they knew they broke it or not. You need to be aware that noone had been in that attic for years. You also need to be aware that it was summertime and the air conditioner runs nearly all day. When it is running there is water moving away from the air conditioner on a steady basis. If this had been previously broken the water would have shown up sooner.

In the meantime Bay Electric sent Hampton Roads Computer an invoice for 1500.00 for the work that had been done. Hampton Roads Computer had not ordered this work. Les Walker claims he never ordered this work. As to the damage caused to my building Bay Electric disavows any responsibility. In a telephone conversation to bay the salesman say his employee (who had been there less than 2 weeks) denied breaking the pipe. He did acknowledge seeing it broken.

I wrote a letter to Bay. In the letter to Bay i stated that they had incorrectly billed HRC for the work. I also stated that I felt they were responsible for the water damage to my building. I asked that correctly bill whoever authorised the work. I even gave them the information necessary to Bill Venturenet. I warned them that Les claims he didnt order the work. I asked that they get with me to resolve damages to my building. I asked that they also get with me as the owner (me) of HRC to resolve equipment damages.I never said that they wouldnt be paid by Venturenet if billed nor did I state a settlemet amount for the damages. I left it open to negotiation. They received the letter and the same day (fri 7-14-2000) filed a lawsuit in York county suing me personnaly for their Bill. on Monday 7-17-2000 they called me and told me they werent responsible for any damages and that HRC had ordered the services and if we didnt pay it they were going to sue us (they never mentioned they had already sued me) I guess that was just harassment to add to all the other injuries.

in closing, I WOULD SAY IN THE STRONGEST OF TERMS DONT DO BUSINESS WITH THIS VENDOR.

Jim Nichols
