BANK OF AMERICA Credit protection for my cedit card was not honored. submission of all required info was submitted to no avail. Omaha Nebraska
On December 1, 2004 I was terminated from my job at Kerotest Manufacturing in Mansura, La. At which time I informed My supervisor of an injury I had sustained and not acted on because of the work load that would have challenged the companys position for experienced personnel in my area of responsibility.
In the previous year I had applied for and obtained approval from Bank of America for Credit Protection Plus on my Credit Card. My last payment to Bank Of America was 12/26/2004 for $310.00 bringing my balance owed down to $2558.63.
I applied for credit protection under the terms listed in their terms of use in Fleet Bank (R) Protector Plus Program In December 04, 2004. I did not hear from them until March 31,2005 requesting more information which I submitted and believed that all was then taken care of. Wrong!! As I stated I had been injured which was another reason for using the Protector Plus Program. I was hospitalized for 21 days during January and february of 2005 and continually under a Dr's care until January 2009. During this time Bank of America Chargted off the credit card account in May 2006 as reflected on my credit report and obviously sold their interest to several collection agencies. The last collection agency (Babovitch & Spedale located in Metairie,la) has attempted to obtain a Summary Judgement for approximately $4500 but was denied today in Judge William Bennett's Court today June 22, 2009. How can I resolve this matter. I am on fixed income (Social Security) 70 years young and need help.

Paul, Unfortunately there is likely no simple solution to your issue. I'm not sure how much the protection program would have helped you even if it was in effect. The bottom line is that you owed at least $2558 in 2004 and haven't made a payment since. Regardless of Karl's largely irrelevant rant, they have the legal right to collect on this debt through judicial process. This could ultimately result in a judgment and ensuing garnishments. Your Social Security income is likely safe from garnishment, but any assets you have could be in jeopardy. The most effective way to solve this problem would be a bankruptcy filing. This may not be in your best interest, however. Fortunately, many bankruptcy attorneys offer free consultations. If you shop around, you should be able to find one who can offer you an honest (and free) opinion as to whether bankruptcy would be right for you. Short of bankruptcy you could attempt to negotiate a smaller settlement, i.e. for the principle owed with forgiveness of the fees and penalties. They would likely get nothing out of you if you were to file bankruptcy, and may be amenable to negotiations. At any rate, there is no substitute for competent legal advice regarding your situation. You may do well to seek out legal aid/legal assistance outfits in your area. I'm sorry I can't offer you an easier solution. Best of luck to you!

The PEOPLE of the United States of America were the REASON that the $700 BILLION 'TARP' became a reality & much of that money, which is TAXPAYER'S MONEY, was injected into these banks in order to keep them afloat, right?
