Let me start by prefacing I am a registered Financial Advisor in Fl.  I was pre approved for a mortgage by JPM, a representative of American Mortgage of Altamonte Springs, John Heinlein, who was my neighbor, told me they would not show up for a closing, however he and his company would.  That began his deception.   I was constantly told that financing was difficult even though I have perfect credit plus the most secure income you can have; PBGC and Social Security.  I had more than the requisite 20% down.  Never was I told at the beginning that my interest rate would be a point above the going rate.  I proceeded with multiple credit checks that iI paid for plus an appraisal.  I also had to have a detailed questionnaire filled out by the HOA that cost $300.  At that point I had almost $1000 invested and I got approved by Mr Heinlein’s choice of lenders.  Then I started hearing about how the lender had an investor who needed more than the going rate because of the property being a Naples condo.  I still assumed, wrongly, that 4.5% would be adequate.  Then Mr Heinlein tells me 5%!!!  I knew from the market that rates were falling yet I was paying more than a full point above the market rate.  Too late to cancel, I had to accept 4.875%.  However I still trusted Mr Heinlein.  Now my scheduled closing and keep in mind that Mr Heinlein and the lender have had my contract for over 2 months.  The lender does not show up.  Mr Heinlein tells me that my legal team failed to  fill out an e-mail.  He also says the paralegal is crazy which I never mention to them but points to his deception.  I ask about the e-mail and as it turns out Mr Heinlein sent it to the wrong address.  The legal team at Salvatori, Wood, Buckel, Carmichael and Lottes of who Kevin Lottes was my attorney are one of the biggest real estate firms in Collier County.  They were appalled at Mr Heinlein’s accusation and asked him to prove it, he never has.  Not to them or to me and he threatened me and yelled when I asked him about it.   At this point Mr Heinlein’s credibility went out the window.  My legal team and I both were in constant contact with the lender and I still lost my deposit of 15K.  Mr Heinlein couldn’t even call me about that; he was not participating at all.  My legal team said he was the worst they had seen in 22 years of experience.  My realtor was also shocked.   Your representative alienated himself from others in his field!

We did manage to close 10 days late.  I received a legal bill twice what I committed to because of the work they had to do with the lender.  I know this is true since I was talking with the lender daily, Jamie Musto.  My Heinlein did nothing

Ms. Hartman: Thank you for your posting. We are in receipt of this review, along with the other comments made on various websites. Despite the fact that our office and I have discussed your issue on many occasions, you still seem to think that we have wronged you in some way. In fact, you presented your case to the State of Florida Office of Financial Regulation and the Attorney General of Florida who both agreed with our position that our business did nothing wrong in this transaction. We have tried on several occasions to explain this to you. Nonetheless, you continue to post unfounded and inaccurate statements on the internet. In the event this posting and others are not removed in 4 days, we will be pursuing an action against you for written defamation and libel.

I am delighted to report that American Mortgage, John Heinlein and I have completely satisfactorily resolved all issues.

During a group meeting with Denise, the paralegal at my legal team for closing, she spoke of extreme difficulty with lenders causing friction for all involved.  I did more research and learned banks are notorious for not approving mortgages.  The chaos of my delayed closing created severe circumstantial stress.  Over and above all the normal homebuying stress my closing costs increased and a re-pipe of my home had to be cancelled causing lost deposits and Collier county permits.  This was a financial burden that has taken over a year to recover.  I now realize the dysfunction was from our financilal institutions.  I retract and apologize for my statement of John Heinlein as a dishonest, deceptive and duty shirking individual.  Not unlike Mr Heinlein's characterization of Denise and others, I felt betrayed at that time and needed to defend myself.  I felt like a snowflake in an avalanche; my last mortgage was in 2003 and the situation is much more confrontational.  My legal team has forgotten Mr Heinlein and moved on. 

Mr Heinlein is an excellent family man.  He actively participates in his son's education and activities.  He is active in the community.  If you are in the market for a home and need financing give him a call.  I'm sure he will help you to the best of his ability.  I would like to thank Mr Heinlein for helping me through the process of obtaining a mortgage.

Mr Heinlein's lackadaisical attitude extends today.  I have never been contacted by him or his company even though I have sent letters to them before I posted negative reviews anywhere.  He cost me money since my lawyer increased his bill because he did Mr Heinlein's work.

The Financial Regulation office only said John Heinlein's actiion was not illegal.  They did keep my letter on file for future complaints. 

Mr Heinlein exhibited a total lack of customer service; he could not even call when I lost my entire deposit, $15000.00.  Plus the next morning I am on the phone with the lender along with my attorney, Kevin Lottes and the lender says can we close in 3 weeks.  This is when I have nowhere to live and have lost my deposit plus all the other cost associated with moving, appraisal, inspections, etc.  Why wasn't Mr Heinlein on the phone or at least keeping the lender on the ball?  My lawyer had to do all his work and had done much more throughout the whole process.

My interest rate is high for my credit rating and down payment.  I received a 4.375 commitment from JP Morgan.  Mr Heinlein told me they would not show up to closing.  He said he would which was/is a blatent lie.  Plus he forced me to take a 4.875 rate after I had paid for an appraisal, multiple credit checks and a survey; over $1000 in costs.  I felt it was too late to back out.  None of that was disclosed when he is telling me JPM won't show up for closing. 

Through the process of closing there were details that needed Mr Heinlein's attention.  Kevin Lottes, my attorney had an issue because he did not receive a form from Mr Heinlein.  Mr Heinlein sent it to the wrong e-mail address and lied about having a copy of the e-mail being sent.   When I asked Mr Heinlein he yelled at me and threatened me.  He said he did not have time to prove his actions to me or my attorney.

I have had other mortgages; none of the mortgage brokers have been as lackadaisical as Mr Heinlein.  I was very disappointed and will publicize my experience.
