I was going to Wal-Mart to have my tires rotated and balanced. As I was pulling into the back of the store to park my car, a Wal-Mart employee backed into me with another customer's car. The police were called. A video was taken of the accident. The manager came out and took pictures immediately.

After I did some shopping and returned to pick up my car, the manager told me that they viewed the video and it definitely was the employee's fault. In fact, she said that the employee was terminated on the spot because he falsified his employment application and did not have a valid driver's license. She told me to obtain two estimates.

I obtained my two estimates (damage around $720 to $750). Turned them in to the manager. Several weeks went by and I did not hear anything. Called the Wal-Mart store and the manager no longer worked for them. Nothing had been submitted to their insurance co.

Finally the insurance co called (Claims Management, Inc) and told me that they were denying my claim as the accident was partially my fault. How can this be, when the employee backed into me???

It probably is not an insurance company but just a dep't of walmart trying to dust you off. 90% of people can't be bothered pursuing these type of things so companies like walmart save million$ every year. You should send a letter back to them telling them that their company has already accepted liability demanding full payment for the damages plus other expenses such as rental car while repair is being done, babysitting expenses while having to deal with repairs and any others you can think of. Warn that if they do not send you payment in full within a reasonable time (1-2 weeks) you will be filing in small claims court for substantially more. If you get no reply or a further dust-off letter contact your local court and file against them for as much as you can reasonably justify.
