We ordered a new roof from Phoenix Exteriors in late September. We had a signed agreement for a new roof with their salesperson, Corey Cross, yet our roof still sits unrepaired in April. We gave Corey a deposit of $5,496.61 on Oct. 3, 2022. Phoenix Exteriors refused multiple times to honor the contract and refund our money. This was a breach of contract for nonperformance. I tried to contact Corey and their manager, Nathan Hembree, to find out when work would start many times in October and Novmeber, yet they did not return my texts or calls for weeks. Nathan then requested we pay for additional ice and water shield to code. Original contract states that this and all repairs will be to code. Nathan also requested we pay an additional $855 for chimney flashing in a new contract even though this was apart of the orignal contract. Corey also had in the original contract 5 free boards and their company later tried to remove these from the contract. These are all breaches of the contract. They agreed to repair our damaged soffits but later tried to remove these in a new contract. We were told the roof would be completed in about 4 weeks, we now have additional damage due to their negligence a incompetence. We informed Cara Rojas, Operations and Administrative Director, that their company has breached the contract multiple times, we need a full refund, and ignored our request.

Phoenix Exteriors later claimed weather was the reason for the delay. Oct and Nov had several available days to complete the roof. They also failed to apply for the permit for the roof in October. Phoenix Exteriors did not apply for the permit until December 5th. Two months after we signed the contract. This is a breach of contract for nonperformance. Phoenix Exteriors also failed to install tarps in two areas of our roof that were leaking after receiving our deposit. This neglect by their company has now caused further damage to our roof and interior. Every roofing company should know to install tarps in areas with visible leaks. Yet they neglected to do so because Cory used a drone to inspect the roof instead of physically inspecting the damage.

Owner, Eric Stanis refused to honor the contract and refund. He instead told us to cancel the contract which they have already breached multiple times and will charge us cancellation fees they he will determine. This is an unethical practice by a licensed business. The contract states that if acceptance is declined by Phoenix Exteriors for any reason, all deposited monies will be refunded by Phoenix Exteriors. They have declined to abide by this contract and have refused to refund all monies. The contract also states that any modifications to this contract which change the cost, materials, work to be performed, or the estimated completion date must be in writing & signed by all parties. We never signed the proposed changes they tried to impose. Because of all of their breaches, Phoenix Exteriors is illegially holding our $5,496.61.
