Emagispace reached out to me to utilize their moveable wall system in my coworking space. I signed a refering agent agreement to get disounted rates on their product and also to have the opportunity to get a referall fee for anyone who came into my space to see their product and turned into a sale.

From the beginning of the conversations I explained to them that nothing was set in stone and that we were simply working on moving into a bigger suite but no lease had been signed. They said no problem and simply just wanted to get the ball rolling in the case that we did want to purchase their product and move forward with the partnership.

As we got closer to signing a lease they reached out and told me that if I was willing to pay for the product upfront they had a November discount that I could qualify for as a referring partner. I told them the lease still wasn't signed and I could not be locked into $15k in purchases if for any reason the lease didn't work out or anything were to change as far as layout or anything else goes.

They assured me that it was simply to lock in the rates and that we could change our order at anytime. I paid the money and then a month later they reached out and told me they noticed I was missing the finished wall paneling on my order and that it was going to be over $4k more to add it on to the order.

After several back and forths they agreed to comp a certain amount of the cost and we took some product off the order in order to get the cost back down to an amount we could still be ok moving forward with. Soon after we found out the whole layout had to be changed so I reached out to emagispace to see if there would be any issues and they said absolutely not. And everytime after that when I reached out with any changes they always said "it's no problem we just want to customize the order to exactly what you want don't hesitate to reach out with any other changes".

When we finally got the order to what it needed to be I asked them to send me a final invoice along with all the shipping information. That was on a monday, by friday I never heard back from them so I reached out and notified Kim that I needed the updated invoice and shipping info to sign off on everything. She said she'd get it to me as soon as possible but never got back to me.

Monday morning I get an email with the updated invoice and a notice saying the product would be delivered in a few hours. There was 300 sf of block on the order that I did not need. When i reached out to Kim she told me that all orders are final and that even though the order was able to be changed I was on the hook for the entire order.

I reminded her of the conversation we had before I made payment and how I explained to her we didn't even have a lease signed yet and how she assured the 15k was just to lock in the rates and we weren't on the hook for anything. She responded by telling me that while that was true at the time since then our order was customized therefore there were no refunds.

She then sent me their terms and conditions that stated no refunds, however, that was the first time they ever disclosed any of those terms to me. They were not on anything I signed or any invoices or estimates. Also in their terms it says no refunds without emagispaces consent. She assured me several times that we wouldn't be held liable for the $15k if anything changed and that it was simply to lock in discounted rates.

I spoke to my credit card company and they advised me to talk to Emagispace and try and resolve it with them but if they weren't willing to work with me to refuse the order. I spoke to the CEO of the company and told him all I wanted was something in writing that would assure me I wouldn't be charged for the extra 300 sf of product that I could not use.

I even offered to pay the restocking fee that is in their terms and conditions. He refused but later said we could probably figure something out but I needed to accept the order. I told him I needed something in writing before the order came because I could not trust them. He wouldln't give me anything in writing so I refused the order. I never recieved any product from emagispace all the product was shipped back to them without ever even reaching my office and still they have refused to give me any kind of refund.

So now they have all my money along with all the product I ordered. Looking back their sales practices were very deceptive. First they charged me for a wall system that didn't include the finished paneling and then they tried to charge me for 300 sf of block I did not order.

In retrospective I was naive for trusting them and should have made sure I had it in writing however everytime I emailed them with a concern they would call and we would work it out over the phone, I just believed they really wanted my as a referring agent and were willing to uphold everything they promised me.
