I opened a mailbox at this establishment on February 16, 2021, with two co-applicants. This mailbox comes with one key which was never received. I was informed that a new key was being made. I did inquire a few times when I would receive a key and on the last occasion was informed “ we are always here so we can get your mail for you.” and also informed that I could call their cell phone numbers to retrieve my mail on the weekends.

Cissy posts business hours on the door and it was verified verbally. The hours are Monday-Friday from 9:30 AM to 6:00 pm and are closed Saturday and Sunday. I attempted to collect my mail several times but found this business was closed during business hours. It was not until March 26, 2021, I started to document the absence.

On this day at 1:00 pm, I went to retrieve my mail, and Cissy's was closed. I waited in the parking lot for 40 minutes. I called Cissy's cell phone number at (704) 200-5115 and employee Leslie at (704) 453-9267 on three occasions but no one answered. I went into the insurance business next door at unit 115. I asked if anyone would be in at Cissy's today. The employee asked my name and when she found out who I was she said “I have your packages.” she explained that since the employees are gone a lot, they would grab packages left at the door for them. I asked for my mail and said that I would provide my driver's license to prove my identity. The employee stated that she could not give me my mail.

On March 29, 2021, I placed an Amazon order and three items were shipped to my mailbox. The carrier claims that two of the items were handed directly to the resident and one item was left at the door. I never received these items. I asked Cissy if I had any packages from Amazon and she said no. I replied that it has been delivered and she claimed that she never got them. I have disputed the transaction with Amazon but since Cissy accepted two items, and one was left at the door, I was not able to get my money back.

On April 2, 2021, Co-applicant was informed by the dealership where a vehicle was purchased that the DMV documents that were needed to register the vehicle were delivered to the mailbox. A call was made to Cissy at 4:28 pm and informed her we would be stopping by. Cissy claimed that she had a doctor's appointment and would be gone by the time we got there even though it would be less than five minutes. Cissy hung up the phone and was closed when arrived during business hours.

On April 5, 2021, I went to Cissy's and attempted to send a UPS package and was informed that I would be charged. I explained that I have sent several packages and was never charged. Cissy explained that since I only signed a 6-month contract instead of 12 months, I would have to pay any shipping through UPS and or FEDX. She reluctantly sent my package but claimed it would be the last time she would do so without a $.75 fee.

I reviewed my contract and does not indicate that there is a fee for sending packages through UPS or FEDX. I called Cissy's pack and post on April 14, 2021, to resolve these issues and got the business answering machine 3 times.

I filed a small claims suit for breach of contract and the matter was heard on October 6, 2021. Cissy Agurs knowingly and willfully made false and fraudulent statements in court, She claimed that customers do not get a mailbox key because they are not allowed in that section of the building. It states in the contract that you get a key. On April 2, 2021, she stated that she was there until closing and that no one showed up 45 minutes later and she left. This would be at 5:13 pm and the business does not close until 6:00 pm. She denied that anyone retrieves customers' mail and packages but does not have a dropbox after hours.

She tried to deflect by claiming she is still getting my mail and I could have contacted her to resolve these issues. I filed for a change of address in June of 2021 and if the business was open during the hours that are posted or answered the phone, I could have talked to her. The judge decided that it was my word against hers and dismissed the case.

Cissy took two packages, she lied about receiving them and kept them for herself, and another package was left at the door. She could have taken this one, or someone in the complex and it's my understanding that there aren't any security cameras. Cissy's Indian Trail Pack N' Post engages in deceptive business practices and is in violation of 18 U.S. Code § 1708 - Theft or receipt of stolen mail matter generally. I understand that according to the Secretary of state of North Carolina records indicate that Cissy opened her business on December 28, 2020, being a brand new business does not excuse her illegal behavior.
