I have had my Bank of America credit card which started as a Fleet card for well over 18 years and have been an excellent client..until I had back surgery 15 months ago and was late on 3 payments. I paid the fees without complaining. They raised my APR. I asked why and was told I was late on a couple of payments but could request a review in a few months to get it back down from 29%. I was at 9%. I called 8 months later and was told "no" because I had missed those payments. I asked what happened to my review and was told they don't do that. Now, I never planned on filing bankruptcy (big mistake now!) This company assumed I was going to do that even though I was faithfully paying more than the minimum. I received a bill recently that had me WAY over the limit and I was shocked as I hadn't used the card for quite some time. Bank of America lowered my limit under what I owed and proceeded to charge over the limit and late fees for that! I called and told them a mistake had been made and I didn't mind the lowering of the limit, but not under what I owed! They said they would fix it. They sent me a letter thanking me for a request of a credit line increase!! You've got to be kidding me!!! Now they raised my minimum to where I can't afford it at all and they tell me the government gave them the right to do this to help me pay off my card faster! Don't you think if I could pay off this ridiculously high priced card I would have? Who wants to pay 29% interest to these guys?! So let's see, live in my car and pay the credit card a minimum payment of what they request until they raise it again and I have to get out of the car and steal a shopping cart and card board box or find another scam company to negotiate a settlement with them? I had to find that scam company as my credit is now ruined to the point of no return and I am so depressed. By the way, it's all of the credit card companies that can do this now because the government passed the okay for them to go after debt owing americans no matter how small or large of debt and they now want you to go ahead and file for bankruptcy because they will get all of their money and you will be ruined because filing bandruptcy isn't what it used to be since the government changed that too. It's a vicious cycle and I've learned a lot too late. They start witht the APR then you'll see the minimum go up. Look at your bill.

Go ahead and get a free consulatation with a BK attorney. You may still be able to file if your income really cannot cover all your payments and expenses. I know these credit card companies can be total blood-sucking jerks. I had a similar problem with one of these companies, where they raised my interest rate so high there was no way I could EVER pay it down, and then they wouldn't even negotiate with me. I was unemployed at the time, and ended up filing BK.
