Hello Rip Off Report, I am contacting you for help with a Creditor on my personal credit report. I have already tried and disputed these unauthorized accounts on my credit reports via the online portal through Credit Karma with all 3 credit bureaus, Equifax, Transunion and Experian on 2/5/2018. After those expired on 3/5/2018 past their legal time period for proof, I have now sent written, USPS Certified Mail with Return Receipt disputes again weeks ago and still no response. They are ignoring several Federal Laws in place for consumer protection. I was a legitimate victim of fraud between the periods of 2008 to 2015 and just realized this 2 months ago when I decided to check my credit report. I believe this creditor is being deceptive & dishonest with my disputes. Although I am not using an Attorney to represent me with this issue yet, I did receive some guidance from a Consumer Protection Attorney. They suggested I send the company a written & notarized FCRA Section # 609 Debt Validation Letter for legit proof that the debt was legally my own. They suggested I contact the CFPB, FTC, State Attorney General and BBB if they continue to ignore my requested information. In addition, depending on which Credit Bureau, this company has pulled between 4 to 7 "Hard Inquiries" on my credit report over the course of 2 years. By federal law, FCRA Section # 609 they must provide proof of such within the 30 day time period or it must be removed immediately off of all my credit reports. This is impairing my ability to obtain any credit and is causing a huge problem within my family. Being a victim of Identity Theft from several years ago has been an awful amount of time, work and persistence just to fix this, especially because it was from so many years ago. All of this trouble being caused by this Creditor refusing to help resolve this issue, acknowledge the truth and fighting over 3 late payments from 2011 and 2012 totaling $200 or so dollars. They claim that I entered into a contract with them by telephone or internet but yet cannot produce any proof it was me. I am asking this creditor to follow Federal Laws, especially in regards to the FCRA. As is prescribed by law, this issue should of have been corrected within the 30 day time period in accordance with Section #609 of the FCRA, as I have written proof of the delivery dates for my dispute. This company needs to immediately acknowledge & verify/certify that this debt is not my own and provide a written response sent via USPS Certified Mail of this proof. Old billing statements will not be accepted as proof and are not legally admissable. In addition, they need to contact Experian, Transunion and Equifax immediately to remove this error, not in a month either. The redundant Hard Inquiries on my credit reports need to be corrected, including Lexis Nexis and/or Sagestream if necessary. If not, I will file disputes with any additional credit reporting companies. Please note Capital One Bank, I will not quit or go away until my good credit history is completely restored and I will begin filing lawsuits next, my Attorney already has the paperwork ready to go and waiting on your B.S. illegal "proof." Let's see if a $200.00 fraudulent account is worth 1000's in fines. Thank you very much. Best regards, J.M.D.
