I am a victim of fraud.  I had a checking account with bank of america.  I was looking on line for a consolidated loan.  I found one who deposited 990 into my account.  I never touched the money they deposited and I couldn't any way because there was a hold on it.

My account was closed with no communication from my bank.  I had money I deposited from a pay roll check that cleared and they will not let me have my money. They said I have to prove it is valid/  Hello...the check cleared, I need my money desperately. 

They also lied and said they would send me an email explaining how to prove my money was valid.  They never sent it.  I know I should  have been more careful but they are treating me like a criminal.  I desperately need my money.

You say that they are treating you like a criminal. Well technically you were a criminal. The funds you received were fraudlent funds so by you receiving them you became an accessory.   The fact that you were desparate or didn't know doesn't really matter. Now, while technically you could actually get in legal trouble it is unlikely they will have you charged with anything.  This is not to knock you down, but give you a bit of reality to think about.

First of all be glad that BofA actually did put a hold on the funds, as part of this "loan" you received this person would have(if they didn't already) request you send them back the money as part of a "good faith" payment by way of a Money Order or even Gift Cards. However, BofA would have eventually reversed the funds. At that point your account still would have been closed, but you would then also be legally on the hook for paying BofA the $900 back.

As for some bad news, it is unlikely that they will open your account back up because by accepting that one deposit you have become a high risk. What is more  ikely is that they will hold all of your funds in the account for 30-45 days to make sure there are no outstanding debits coming in. At the end of this period they will send you a check for the remaining amount.  Yes, this is what you agreed to when you opened the account.

In order to prove that the funds are vaild you could try getting a letter from your employer and see if they will accept that. You may also want to try going into the branch to see if they can assist. However, realize that once you are with their "risk" department it is unlikely that anyone will help you at the branch, but may be worth a try. This unfortunatly is how most banks work.

So in the future, if anyone you don't personally know offers to deposit money in your account or sends you a check asking for money back. Regardless of how legitimate the reason sounds, realize that it is a scam and the best thing to do is just move on.
