CONSUMERS BE AWARE BE VERY AWARE...Bally's total fitness is an evil empire who will destroy your credit.

Bally's fails to adhere to their contract term and conditions. Moreover, their contract contains incorrect information. In the process of refinancing my house I discovered that I was being charged an additional $3500 for a lower credit score. Having excellent credit history, I investigated my credit report and discovered Bally's stated I owed $700 to cover late payments.

I was shocked to find this out considering I mailed a termination letter on September 16, 2009 and I had never received any notification that payments were late. When I called the Bally's corporate office, a Bally's representative told me that the contract states an incorrect address in the termination clause. I was additionally told that I had to make the payment for my termination request to be considered and to avoid being sent to a collection agency. In good faith that Bally's would adhere to their contract and consider giving me a refund, I paid the unpaid balance.

I followed up with a written letter to Ballys with a copy of my original termination letter on February 2, 2009. Unfortunately I did not send my original letter certified mail, however, this time I have fax confirmation and a certified receipt.

Bally's responded to me on February 12, which I received on Feb in writing stating my terms and conditions in my contract. I was perplexed at this response as I am very well aware of my terms and conditions. In the communication, it stated nothing about actually terminating my contract. I have yet to get in contact with them during the work week as it typically takes at a minimum 25-30 minutes to get a representative on the phone.

Bally's contract states that they will respond in writing to termination requests within ten business days, however, it has now been over 20 business days and I have yet to receive a response from them. When I contacted a representative in the middle of February , I was told that they are back logged and I should receive a response within three to four weeks.

I plan on disputing my credit card payment and have filed reports with the three credit bureaus. They need to be held accountable for their actions. Their lack of responsibility and integrity is a disgrace and is now costing me close to $5,000. I find I am not alone in this situation. Somewhere something must be done to stop this evil empire from destroying people's credit. I have contacted Seven on my Side and do not plan to rest until this is resolved.
