Ameriquest Mortgage Company is a ripoff. They tell you nice things when you're desperate for money and "are your friends". The closing is the day you start down the road to Hell.

First, our at-home closing was delayed, putting our credit situation in worse shape. Second, the primary was supposed to be my husband. The loan was supposed to be a no-doc loan but came at closing as a HUD loan, with me as primary and I had the worst credit scores but the documented income. The rates and the closing fees were only provided at closing and were different from disclosure on the phone.

My husband and I are around 50 years old and both are disabled. Next, instead of rental property, the mortgage came as primary residence. Then, there was the pre-payment penalty not disclosed before but with the closing documents. The Good Faith Estimate came with the closing papers. Calling the office was a three-hour merry-go-round. Everyone is always at lunch, on break, or in a meeting.

The funds were not released at the closing and a seven-day rescision paper was included. This was without notice. I was so angry I was in tears. If we weren't desperate, I would have told them to put the mortgage in a safe place where "the Sun doesn't shine". Because my Credit Union holds funds over a certain amount, we still didn't have our funds to make payoffs, after we got the funds. Our credit trots on down to the toilet.

Flood insurance documents were in the closing documents even though the home was not in a flood zone. The closer failed to advise us to get flood insurance. It would have cost us about $200, instead of over $1000, which raised our payments.

In October, without any notice, they assigned flood insurance, claiming the flood zones had changed, not allowing us to get our own insurance. There is no way to flood the inside of a mobile home in Miami, Florida, without flooding all of Miami. We did not have escrows for insurance.

They took a year's Hazard Insurance for rental property at closing in August of $1101, but did not pay my insurance company. As best as I and my insurance carrier can figure out, they pocketed my $1101 in insurance money because they didn't use the $1101 to pay my insurance when it was due in October.

My carrier requested payment in October and sent me cancellation notices. Ameriquest added $1101 to my escrows to pay, even though they had the year's payment in August and were also taking escrows. My payments went up again so they were now over $100 more a month than the renter was paying.

Paying for two homes, I asked the renter for more money. She could barely pay the rent, due to illness and loss of work. We had to sell. That's the summer of the four hurricanes in Florida.

We finally closed in August, 2004, but Ameriquest either pocketed our escrows for the insurance or paid it in advance to keep us from getting the money. We finally got that $1101 back but never got the original $1101 back.

If the payment was one day late, Ameriquest called all phone numbers, including work, every day until you paid, even as early as 6:oo A.M. and as late as 11:30 P.M. They threatened me and harrased me until I was losing my mind, especially once they knew we were selling the mobile home.

I have pre-paid legal insurance so I began threatening them with a lawsuit, notified by my banker that there were class-action lawsuits. They also hold your payments, asessing you late fees. Obviously, our credit scores are now really in the toilet.

I want to sue for my $1101 damages, fraud, mental pain and suffering and fear that my husband would kill himself over the harrassing phone calls, telling him he was a dead-beat and much worse, calling 10 times a day on some days. Help.....

Lorraine, Don't let them get you worked up on this. Most of these mortgage customer service reps that post here on this site are determined to "redirect" and point to you as the offender. If you have a loan serviced by a sub-prime servicer like Ameriquest, they think of you in that way. Meaning sub-prime loan equals Deadbeat Customer to them. Also provoking you, will cause you to disclose a lot more info on the internet, than you may have really wanted to. There is no reasoning with them. It's their way of being able to sleep at night, after ripping off people all day long. If you keep your cool and realize who you're dealing with, you will be much better off.

EITHER YOU ARE A LITTLE SLOW ON THE UPTAKE OR YOU ARE AN EMPLOYEE. I NEVER GOT ANY DOCUMENTS UNTIL THE CLOSING ITSELF. WHAT PART OF THAT DON'T YOU GET? IN THE CLOSING DOCUMENTS WAS $1101 FOR MY INSURANCE DUE IN OCTOBER (THE FULL PAYMENT). IN OCTOBER OF 2003 THE INSURANCE CAME DUE. THE ESCROWS WERE COLLECTED, AT CLOSING AND EACH MONTH. THE $1101 COLLECTED FOR THE OCTOBER PAYMENT AT CLOSING DISAPPEARED, LEAVING A SHORTAGE SO AMERIQUEST RAISED MY PAYMENTS AND SENT THE MONEY TO MY INSURANCE COMPANY WHEN THE POLICY WAS CANCELED, TO REINSTATE THE POLICY. WHAT DON'T YOU GET ABOUT THE FIRST, I SAID FIRST $1101 DISAPPEARING, THAT THEY TOOK AT CLOSING? WHEN I WAS SELLING THE MOBILE HOME IN 2004, PARTLY BECAUSE OF THE HARRASSMENT, THE ESCROWS CONTAINING MORE THAN $1101 WAS PAID, IN AUGUST A WEEK BEFORE MY CLOSING. WHY, DUMMY, WOULD A COMPANY PAY A PAYMENT FROM ESCROWS THAT WAS NOT DUE ONE WEEK BEFORE CLOSING? THAT WAS MY INSURANCE THAT WASN'T DUE UNTIL OCTOBER. THAT WAS TO KEEP FROM GIVING ME MY MONEY BACK. THAT MONEY IN ESCROWS WAS MY MONEY AND NOT YET DUE. THAT $1101 IS THE MONEY MY INSURANCE AGENT GOT BACK FOR ME, NOT THE ORIGINAL $1101 TAKEN AT CLOSING IN AUGUST OF 2003, THAT WENT INTO SOME FUND OR POCKET. MY I.Q. IS 168 AND MY STUDENTS CAN GET THIS STORY. THERE WERE THREE PAYMENTS OF $1101, ONE AT CLOSING FOR 2003, ONE EXTRA ONE IN OCTOBER OF 2003 TO COVER THE ONE THAT DISAPPEARED IN AUGUST OF 2003, AND THE THIRD THAT WASN'T DUE UNTIL OCTOBER OF 2004 BUT WAS PAID IN AUGUST OF 2004 TO KEEP FROM REBATING ME MY ESCROWS, KNOWING THE CLOSING WAS THE NEXT WEEK. CAN YOU COUNT 1,2,3? THERE WERE THREE $1101 TAKEN FROM ME: ONE HIDDEN THAT WAS TAKEN AT CLOSING, ONE PAID FOR 2003 BUT FORCED TO REPAY IN MY MONTHLY PAYMENTS, AND ONE TAKEN IN ESCROWS AS WELL AS THE REPAYS FOR THE OCTOBER OF 2004 PAYMENT. THAT PAYMENT WAS PAID IN AUGUST EVEN THOUGH THE ORIGINAL $1101 WAS ALREADY THERE AND OWED TO ME, AND NOT DUE UNTIL OCTOBER. THE HOME WAS SOLD IN AUGUST OF 2004. THIS 2004 PAYMENT, THAT WAS NOT DUE, WAS WHAT I GOT BACK, WHICH WAS IN ESCROW, NOT THE ORIGINAL, I SAID ORIGINAL, I REPEAT ORIGINAL $1101 TAKEN AT CLOSING. BY THE WAY, AGAIN THERE WERE THREE $1101 BUT ONLY ONE DUE IN 2003: ONE TAKEN IN CLOSING, ONE REPAID FOR 2003 ADDED TO MY PAYMENTS, AND ONE PAID IN ESCROWS FOR 2004, WHICH WAS NOT DUE BUT WAS PAID AND RETRIEVED. You said the primary on the loan is the "Bread Winner"? Why then am I primary on this loan, with no income (I'm a stay at home mom)and a lower score than my husband??? Why are you posting here anyway???? Are you another Ameriquest " SCUM OF THE EARTH" employee???

I don't even know where to start with this rebuttal. I guess I'll start from the top. You are not a victim. Let me repeat. You were NOT a victim. Let me explain. 1) HUD loan. I'm assuming you saw a copy of you HUD1 statement and assumed you got a "HUD" loan. Newsflash...ALL LOANS HAVE A HUD STATEMENT AT CLOSING! 2) The reason they used your credit is because you are the "bread winner". All companies HAVE TO GO OFF THE PRIMARY INCOME EARNER CREDIT SCORES!! Let me get this straight...you want a company to go off the better of the 2 scores but that person has NO INCOME? Yeah...ok. Good luck with that. No dice. 3)Pre payment penalty not disclosed? It was in your RESPA package sent to you at the beginning of the process. Obviously you don't read your mail. 4)The funds not released on the 7th day? Ok...wiring money to pay off debts IS NOT AN IMMEDIATE PROCESS! The wire goes throught the fed reserve. Expect3 days AFTER THE RECESSION PERIOD to receive the funds. This is also industry standard. 5) Flood insurance without notice. No go on this one either. You received 2 noticing notifying you of the need to obtain flood insurance. Again...read your mail. If you did not obtain insurance...the the company will provide it for you. By the way...the company doesn't just decide one day that you need flood insurance. FEMA decides this and changes it all the time. Again...this is industry standard. You are NOT A VICTIM. Just ignorant. 6)If your payment is 1 day late...you will get a call. If you owed me money...you can bet that I would be calling you too. C'mon...what next... 7)"We finally got that $1101 back but never got the original $1101 back." Ok..so you want to sue for money that you got back?? Good luck with that one too. Let me make sure I have everything clear here. You were desperate and needed a loan. Ameriquest provided it for you and you got what you needed. The only thing you DIDN'T do is read your mail. I cannot understand where your frustration comes from. Let me repeat: YOU ARE NOT A VICTIM

I so hate that you are in the situation that you are in. I am also an Ameriquest customer who is living through hell because of all the fraudulent and deceitful things they have done. The only thing I can tell you is to write everyone you can think of telling them your story. Write to your governor, senators and most importantly, the Attorney General. Also, file a complaint through the Better Business Bureau. I did but they have a fairly good rating so I guess not many people have done this. My one small complaint will not make a difference but if everyone will file, we can change the good rating they have to the poor rating they deserve. Write to Ameriquest's "Office of the President". I have been writing at least one letter every couple of weeks. They have 60 days to respond. I figured they should be miserable, as they have made me, by having to respond to my letters. Well, the "Office of the President" employees (and that's all they are...just more representatives that have no explanations for the exorbitant fees they charge) have now turned me over to their parent company's legal department. But it hasn't slowed me down. I still write letters and I continue to receive the same bull from the legal department as I did the reps. They are very good at skirting all issues they don't want or are able to address. I unfortunately signed a contract with a pre-payment penalty "privilege". Isn't that funny? Privilege. Do you also have this? I just finished 2 years of hell with this company and have yet another to go before I will not be forced to pay their penalty of over $6,000. After the 2 year period, they raised my percentage rate to almost 2% which has raised my payments almost $200 a month. My payments are now over $1,300 and I have since divorced and live on a single income. It's a daily struggle to pay the payments and cope with the stress. Also, 6 months from now, they can increase my percentage rate yet again which I'm sure they will do. But, if you just keep informing everyone of the hell Ameriquest has put you through, I believe it will be a kind of therapy for you as it has been for me. Now, I have been "hateful" on this website as I have been informed by some and I can't say I haven't been. It's just hard not to be that way when their employees are on here defending a company that has, like you said, many class action law suits against them. In fact, I was a part of one of these suits but it really wasn't worth it. The attorney took most of the money I was rewarded (for the many lies I was told) and Ameriquest has retaliated, with a vengence, ever since. I also had pre-paid legal insurance but they didn't do much for me so I opted out. I sent hundreds of copies to them and talked on the phone to the attorney quite a bit. The attorney I was assigned was not local so it was very hard to correspond by phone. I wanted to go into an office and sit across from someone. I hope they do something for you. Your contact may be local and I feel that is a big plus for you. Yes, they do hold your payments just to get their late fees. I was told by a rep that "well, we receive thousands of payments daily ... blah blah blah". And this is our fault? He told me that maybe I should pay my payments a month in advance. Sure, like I can do that. You will get every story in the book if you can get in contact with anyone at all. I've also heard what you said about lunch, breaks and meetings. Or you leave a voice mail only to receive no response. Anyway, I know I wasn't much help but just know I will think of you and hope that we can all get out of the hellholes we are in. Good luck and try to keep you chin up. If you give in, they win. I know it's hard to do. Maybe we need to start a therapy group called "Ameritheft victims unite". Ha!
